Complaints against <strong>the</strong> Affirmative Action Officer should be taken <strong>to</strong> <strong>the</strong> President of <strong>the</strong> <strong>University</strong>.Dissemination of <strong>the</strong> PolicyThe Affirmative Action Policy will be placed in <strong>the</strong> Faculty and Staff Manual and <strong>the</strong> <strong>Student</strong> Handbook.The Affirmative Action Officer will, at least once each year, meet with administrative officers and departmentchairs <strong>to</strong> discuss <strong>the</strong> Affirmative Action Policy, <strong>the</strong> role of <strong>the</strong> Affirmative Action Officer, and <strong>the</strong> AffirmativeAction Committee. The crea<strong>to</strong>r may be any faculty, staff, or student at <strong>Methodist</strong> <strong>University</strong>.Imprint is <strong>the</strong> pattern, design, or mark <strong>to</strong> indicate origin.Intellectual property includes works eligible for copyright protection and inventions eligible for patentprotection under U.S. and international law.Ownership is legal title coupled with exclusive legal right <strong>to</strong> possession.Sponsored Research refers <strong>to</strong> intellectual property created as a result of work conducted under anagreement between an external sponsor and <strong>the</strong> <strong>University</strong>, or between <strong>the</strong> <strong>University</strong> and employee(faculty, staff, and/or student), that specifies <strong>the</strong> ownership of such intellectual property shall be ownedas specified in said agreement.Work for hire is a work prepared by an employee of <strong>Methodist</strong> <strong>University</strong> (faculty, staff, and/or student) within<strong>the</strong> scope of his/her employment, or a work specially ordered or commissioned by <strong>Methodist</strong> <strong>University</strong>.PolicyTraditional/Individual/Aes<strong>the</strong>tic Products. This term refers <strong>to</strong> work reflecting research and/or creativity,normally considered as evidence of professional advancement and scholarship. It includes scholarlypublications, journal articles, reports (contracted or o<strong>the</strong>rwise), research bulletins, monographs, books,plays, software, and works of art. Such products are protected by traditional copyright and solely belong<strong>to</strong> <strong>the</strong> author(s). Unless specifically stipulated by <strong>the</strong> categories below, all intellectual property producedby faculty, staff, or students belongs <strong>to</strong> its crea<strong>to</strong>r.a. Sponsored Research. This term refers <strong>to</strong> products for which faculty or staff have received additionalresearch funding or support. If <strong>Methodist</strong> <strong>University</strong> sponsors <strong>the</strong> research it may assert ownershipwith research funding or support. If <strong>Methodist</strong> <strong>University</strong> sponsors <strong>the</strong> research it may asser<strong>to</strong>wnership with <strong>the</strong> crea<strong>to</strong>r, but only with a written agreement authorizing <strong>the</strong> sponsored research;<strong>Methodist</strong> <strong>University</strong> cannot at a later date claim ownership. If a body o<strong>the</strong>r than <strong>Methodist</strong> <strong>University</strong>is sponsoring research, <strong>the</strong>n <strong>Methodist</strong> <strong>University</strong> should ensure that any external sponsorshipwritten agreements are explicit about ownership issues for <strong>the</strong> crea<strong>to</strong>r and for <strong>Methodist</strong> <strong>University</strong>.In absence of any written agreements regarding ownership of results of <strong>the</strong> sponsored research,<strong>the</strong> intellectual property will belong <strong>to</strong> <strong>the</strong> crea<strong>to</strong>r.b. Online Courses. Ownership of online or digitalized course materials remains with crea<strong>to</strong>r. Faculty,staff, and students shall not license, sell, or grant third parties a right <strong>to</strong> use online materials which<strong>the</strong>y have created, own, and that are technologically mediated by <strong>Methodist</strong> <strong>University</strong> when <strong>the</strong>material contains <strong>the</strong> imprint of <strong>Methodist</strong> <strong>University</strong> without <strong>the</strong> prior approval of <strong>the</strong> Vice Presidentfor Academic Affairs or his/her designee.14
