Thisunique community has many of <strong>the</strong> aspects of a small <strong>to</strong>wn. The <strong>University</strong> President is <strong>the</strong> community leader,<strong>the</strong> Administrative Committee is like a <strong>to</strong>wn council, and <strong>the</strong> Maintenance Department provides public worksservices. Everyone who lives, works and studies on our campus, is a member of <strong>the</strong> <strong>Methodist</strong> <strong>University</strong>community. Like any o<strong>the</strong>r community, <strong>Methodist</strong> <strong>University</strong> has developed a set of standards for its members <strong>to</strong>follow. The <strong>Methodist</strong> <strong>University</strong> Judicial Code is <strong>the</strong> set of rules that every member of <strong>the</strong> <strong>Methodist</strong> <strong>University</strong>community has agreed <strong>to</strong> follow. <strong>Student</strong>s should review and understand <strong>the</strong> Judicial Code, because everystudent who enrolls at <strong>Methodist</strong> <strong>University</strong> is subject <strong>to</strong> <strong>the</strong> provisions of <strong>the</strong> Judicial Code.It is impossible for a single Judicial Code <strong>to</strong> cover every situation. With this in mind, <strong>the</strong> Presidentand <strong>the</strong> Board of Trustees of <strong>Methodist</strong> <strong>University</strong> have authorized <strong>the</strong> Vice President of <strong>Student</strong>Development and Services (hereafter referred <strong>to</strong> as <strong>the</strong> Dean of <strong>Student</strong>s) <strong>to</strong> enforce, by sanctionor policy, situations that may not specifically be addressed in this handbook including mattersthat are governed by local, state, and/or federal laws. Changes <strong>to</strong> <strong>the</strong> handbook will be publishedin <strong>the</strong> form of an addendum, which will be given <strong>the</strong> widest distribution reasonably possible.<strong>Student</strong>s are responsible for <strong>the</strong>ir actions. Being under <strong>the</strong> influence of alcohol or o<strong>the</strong>r drugs is no excusefor improper action and, in fact, makes <strong>the</strong> violation more serious. <strong>Student</strong>s are also responsible for <strong>the</strong>iractions during off-campus trips. Those students whose behavior puts <strong>the</strong>mselves or o<strong>the</strong>rs at risk or whounreasonably disrupt <strong>the</strong> <strong>University</strong> environment will be expelled from <strong>the</strong> <strong>University</strong>.<strong>Student</strong>s must carry <strong>the</strong>ir <strong>University</strong> Identification Card at all times. All students must present <strong>the</strong>ir<strong>University</strong> Identification Card <strong>to</strong> any faculty or staff member upon request, failure <strong>to</strong> present <strong>the</strong>ir cardwill be considered a violation of <strong>the</strong> <strong>University</strong>’s Failure <strong>to</strong> comply with <strong>the</strong> Direction of College Officialpolicy. <strong>Student</strong>s will be subject <strong>to</strong> <strong>the</strong> judicial sanction outlined under this policy.The Silent Witness ProgramCommunity members who have information or knowledge with regard <strong>to</strong> criminal or illegal activity mayanonymously report that information through <strong>the</strong> Silent Witness program. Alcohol and O<strong>the</strong>r Drugs (AOD)Alcohol PolicyExcessive use of alcohol has led <strong>to</strong> <strong>the</strong> early termination of more academic careers, and <strong>the</strong> disruption ofmore personal lives, among <strong>University</strong> students than any o<strong>the</strong>r single cause. Half of all accidental deathsinvolving <strong>University</strong> students can be attributed <strong>to</strong> <strong>the</strong> excessive use of alcohol. At <strong>Methodist</strong> <strong>University</strong>, weare very concerned about <strong>the</strong> negative impact that alcohol is having on <strong>the</strong> youth of our country. We alsofeel that <strong>the</strong>re is no place for <strong>the</strong> excessive use of alcohol as part of <strong>the</strong> overall development experiencefor any of our students. With this in mind, we have established and long maintained <strong>the</strong> policy describedon <strong>the</strong> following pages.The State of North Carolina prohibits <strong>the</strong> use of alcohol by persons under <strong>the</strong> age of21. It is also illegal, in our state, for a person of legal alcohol drinking age <strong>to</strong> purchase for or provide alcohol<strong>to</strong> anyone who is underage. <strong>Methodist</strong> <strong>University</strong> fully supports and upholds <strong>the</strong> state law. Because <strong>the</strong>overwhelming majority of our students are underage and very susceptible <strong>to</strong> <strong>the</strong> negative impact of alcohol,and because we support <strong>the</strong> mandates of <strong>the</strong> United <strong>Methodist</strong> Church, <strong>the</strong> possession or consumptionof any alcoholic beverage is prohibited on <strong>the</strong> <strong>Methodist</strong> <strong>University</strong> campus regardless of one’s age.Possession is defined as having any alcoholic beverage or its commercially produced container on<strong>the</strong> student’s person, in <strong>the</strong> student’s room, in <strong>the</strong> student’s au<strong>to</strong>mobile, or among properties owned orbeing used by <strong>the</strong> student. Given reasonable cause, residence hall rooms, common living areas, andau<strong>to</strong>mobiles may be searched for alcohol. All residents and/or visi<strong>to</strong>rs who are found in <strong>the</strong> presence ofalcohol possession or consumption are subject <strong>to</strong> <strong>the</strong> same sanctions as <strong>the</strong> individual(s) who actuallybrought <strong>the</strong> alcohol and/or alcohol containers in<strong>to</strong> <strong>the</strong> environment or were possessing or consuming itregardless of how long <strong>the</strong>y were present on <strong>the</strong> scene.Consequences of Alcohol Related ViolationThe first time that a student is found responsible for <strong>the</strong> possession, on campus, of an alcoholic beverage ora commercially produced alcoholic beverage container, he or she will be subject <strong>to</strong> <strong>the</strong> following sanctions:1. Up <strong>to</strong> a $100 fine (The actual amount of <strong>the</strong> fine is related <strong>to</strong> <strong>the</strong> severity of <strong>the</strong> offense).<strong>Student</strong>s will also be assigned up <strong>to</strong> 20 hours of community service, which must be completedwithin <strong>the</strong> designated time given.2. Required participation in a substance abuse assessment and, any follow-up counseling,education, and/or treatment <strong>to</strong> be conducted by <strong>the</strong> Direc<strong>to</strong>r of <strong>the</strong> Center for PersonalDevelopment. If a student fails <strong>to</strong> comply with <strong>the</strong> assessment, education, and/or treatmentrecommended by <strong>the</strong> Direc<strong>to</strong>r of <strong>the</strong> Center for Personal Development, he or she will besubject <strong>to</strong> a minimum of an additional $500 fine, and a maximum of suspension.3. If <strong>the</strong> student is under <strong>the</strong> age of 21, <strong>the</strong> Dean of <strong>Student</strong>s will write a letter <strong>to</strong> <strong>the</strong> parent(s) orlegal guardian(s) of <strong>the</strong> student informing <strong>the</strong>m that <strong>the</strong> student has been found responsiblefor his or her first alcohol related offense. The letter will also recommend that <strong>the</strong> parentsbecome directly involved in an effort <strong>to</strong> create a situation that will minimize <strong>the</strong> chances of<strong>the</strong> student becoming involved in a second alcohol related incident.The second time that a current student is found responsible for possession, on campus, of an alcoholicbeverage or a commercially produced alcoholic beverage container, he or she will be subject <strong>to</strong> <strong>the</strong>following sanctions:1. Payment of a $200 fine.2. Additional participation in a substance abuse assessment and, if required, follow-upcounseling, education, and/or treatment <strong>to</strong> be conducted by <strong>the</strong> Direc<strong>to</strong>r of <strong>the</strong> Center forPersonal Development. As in <strong>the</strong> case of <strong>the</strong> first offense, if a student fails <strong>to</strong> comply with<strong>the</strong> assessment, education, and or treatment related directions provided by <strong>the</strong> Direc<strong>to</strong>r of<strong>the</strong> Center for Personal Development, he or she will be subject <strong>to</strong> a minimum of an additional$500 fine, and a maximum of expulsion.3. If <strong>the</strong> student is under <strong>the</strong> age of 21, <strong>the</strong> Dean of <strong>Student</strong>s will write a letter <strong>to</strong> <strong>the</strong> parent(s) orlegal guardian(s) of <strong>the</strong> student informing <strong>the</strong>m that <strong>the</strong> student has been found responsiblefor his or her second alcohol related offense. The letter will also recommend that <strong>the</strong> parentsbecome directly involved in an effort <strong>to</strong> create a situation that will minimize <strong>the</strong> chances of<strong>the</strong> student becoming involved in a third alcohol related incident (for students under 21).The third time that a current student is found responsible for possession, on campus, of an alcoholicbeverage or a commercially produced alcoholic beverage container; he or she will be subject <strong>to</strong> aminimum of suspension and a maximum of expulsion.75
