<strong>Evaluatie</strong> <strong>verzelfstandiging</strong> <strong>FPC</strong> Van <strong>Mesdag</strong>However, some negative uninten<strong>de</strong>d effects must be mentioned as well: insufficient financialprovisions to <strong>de</strong>al with future retirement claims and constraints in building financialreserves. Furthermore, recently problems have <strong>de</strong>veloped in the capacity for supervision ofleaves (but it is not clear w<strong>het</strong>her this is directly linked to the privatization).Research findings (main research question part II)Interviews have been held with representatives of the two public <strong>FPC</strong>s (<strong>FPC</strong>Oostvaar<strong>de</strong>rskliniek and <strong>FPC</strong> Veldzicht). These interviews took place to see if the preprivatizationbarriers to day-to-day management and to the <strong>de</strong>velopment of cooperationschemes with external partners, which were mentioned by the respon<strong>de</strong>nts of the <strong>FPC</strong> Van<strong>Mesdag</strong>, are currently also experienced by the two public <strong>FPC</strong>s or not. It was found thatthese barriers are in<strong>de</strong>ed real.Building on that finding, from the perspective of the public <strong>FPC</strong>s, privatization ishighly recommendable. From the perspective of the TBS-field as a whole the same is true, asfull privatization of all <strong>FPC</strong>s would create a level playing field; the two public <strong>FPC</strong>s would nolonger be the odd ones out in a sector that is almost completely ma<strong>de</strong> up of privateorganizations. From the perspective of the responsibility that the Minister of VenJ has forthe proper functioning of the TBS-sector (and for the implementation of judicial TBScommitmentor<strong>de</strong>rs) it is however hard to come up with a single recommendation.Upcoming legislation (the Wet Forensische Zorg, Wfz) will provi<strong>de</strong> for significantcompetencies of VenJ (vis-à-vis all <strong>FPC</strong>s) to intervene in case of mismanagement of <strong>FPC</strong>s. Inthat sense, when this legislation is in place, one possible argument for keeping some <strong>FPC</strong>spublic is no longer valid. Another argument is that, because of his responsibility forupholding TBS-commitment or<strong>de</strong>rs, the Minister at all times must be able to place TBSpatientsin a <strong>FPC</strong>. W<strong>het</strong>her in that regard it is <strong>de</strong>emed necessary to keep at least some <strong>FPC</strong>spublic, <strong>de</strong>pends on one’s assessment of the effectiveness of the instruments the Ministerwill have un<strong>de</strong>r the new Wfz (obligation of <strong>FPC</strong>s to accept new TBS-patients, with financialsanctions if they do not comply), especially in situations of limited capacity.xvi
