interest, direct or indirect, in this Contract or<br />

proposed Contract.<br />

By the 15 th day after the reporting month, the<br />

health plan provides a monthly Minority<br />

Participation Report <strong>to</strong> BMHC summarizing the<br />

business it does with minority subcontrac<strong>to</strong>rs or<br />

vendors.<br />

The submission of a Minority Participation<br />

Report may be waived in writing if:<br />

a. The health plan demonstrates that it is at<br />

least fifty-one percent (51%) minorityowned.<br />

b. At least fifty-one percent (51%) of its board<br />

of direc<strong>to</strong>rs belong <strong>to</strong> a minority.<br />

c. At least fifty-one percent (51%) of its<br />

officers belong <strong>to</strong> a minority.<br />

d. The health plan is a not-<strong>for</strong>-profit<br />

corporation and at least fifty-one percent<br />

(51%) of the population it serves belongs <strong>to</strong> a<br />

minority.<br />

If the health plan has been approved by the<br />

<strong>Agency</strong> <strong>for</strong> a waiver of this report requirement, it<br />

must submit a request <strong>for</strong> waiver renewal<br />
