The health plan ensures that all transportation providers maintain vehicles<br />

and equipment in accordance with state and federal safety standards and<br />

the manufacturers’ mechanical operating and maintenance standards <strong>for</strong><br />

any and all vehicles used <strong>for</strong> transportation of <strong>Medicaid</strong> recipients.<br />

The health plan ensures that all transportation providers comply with<br />

applicable state and federal laws, including, but not limited <strong>to</strong>, the<br />

Americans with Disabilities Act (ADA) and the Federal Transit<br />

Administration (FTA) regulations.<br />

The health plan ensures that transportation providers immediately remove<br />

from service any vehicle that does not meet the FL Department of<br />

Highway Safety and Mo<strong>to</strong>r Vehicles licensing requirements, safety<br />

standards, ADA regulations, or Contract requirements and re-inspect the<br />

vehicle be<strong>for</strong>e it is eligible <strong>to</strong> provide transportation services <strong>for</strong> <strong>Medicaid</strong><br />

recipients under this Contract. Vehicles will not carry more passengers<br />

than the vehicle was designed <strong>to</strong> carry. All lift-equipped vehicles must<br />

comply with ADA regulations.<br />

The health plan ensures transportation services meet the needs of its<br />

enrollees including use of multi-load vehicles, public transportation,<br />

wheelchair vehicles, stretcher vehicles, private volunteer transport, overthe-road<br />

bus service, or, where applicable, commercial air carrier<br />

transport.<br />

The health plan collects and submits encounter data, as required elsewhere<br />

in this Contract.<br />

The health plan ensures a transportation network of sufficient size so that<br />

failure of any one component will not impede the ability <strong>to</strong> provide the<br />

services required in this Contract.<br />

The health plan ensures that any subcontracts <strong>for</strong> transportation services<br />

meet the subcontracting requirements.<br />

The health plan maintains policies and procedures, consistent with 42<br />

CFR 438.12 <strong>to</strong> ensure there is no discrimination in serving high-risk<br />

populations or people with conditions that require costly transportation.<br />
