The health plan ensures compliance with the minimum liability insurance<br />

requirement of $100,000 per person and $200,000 per incident <strong>for</strong> all<br />

transportation services purchased or provided <strong>for</strong> the transportation<br />

disadvantaged through the health plan. (see S. 768.28[5], F.S.)<br />

The health plan indemnifies and holds harmless the local, state, and<br />

federal governments and their entities and the <strong>Agency</strong> from any liabilities<br />

arising out of or due <strong>to</strong> an accident or negligence on the part of the health<br />

plan and/or all transportation providers under contract <strong>to</strong> the health plan.<br />

The health plan ensures adequate seating <strong>for</strong> paratransit services <strong>for</strong> each<br />

enrollee and escort, child, or personal care attendant, and ensures that the<br />

vehicle meets the following requirements and does not transport more<br />

passengers than the registered passenger seating capacity in a vehicle at<br />

any time:<br />

Enrollee property that can be carried by the passenger and/or driver, and<br />

can be s<strong>to</strong>wed safely on the vehicle, is transported with the passenger at<br />

no additional charge. The driver provides transportation of the following<br />

items, as applicable, within the capabilities of the vehicle: wheelchairs,<br />

child seats, stretchers, secured oxygen, personal assistive devices, and/or<br />

intravenous devices.<br />

Each vehicle posts inside the health plan’s <strong>to</strong>ll-free telephone number <strong>for</strong><br />

enrollee complaints.<br />

The interior of all vehicles is free from dirt, grime, oil, trash, <strong>to</strong>rn<br />

upholstery, damaged or broken seats, protruding metal or other objects or<br />

materials which could soil items place in the vehicle or cause discom<strong>for</strong>t<br />

<strong>to</strong> enrollees.<br />
