In calculating the amount of each item due to the
CONTRACTOR in every certificate prepared for payment,
sum of less than 50 paise shall be omitted and the total
amount on each certificate shall be rounded off to the nearest
rupees, i.e., sum of less than 50 paise shall be omitted and
sums of 50 paise and more upto one rupee shall be reckoned
as one rupee.
89. Lump-sum in tender: 89.1 The payment against any Lumpsum item shall be made only
on completion of that item as per the provision of the
CONTRACT after certification by ENGINEER-IN-

90.1 All running account payments shall be regarded as payment
by way of advance against the final payment only and not as
payments for WORK actually done and completed and shall
not preclude the requiring of bad, unsound and imperfect or
unskilled work to be removed and taken away and
reconstructed or re-erected or be considered as an admission
of the due performance of the CONTRACT, or any part
thereof, in this respect, or of the accurring of any claim by the
CONTRACTOR, nor shall it conclude, determine or affect in
any way the powers of the EMPLOYER under these
conditions or any of them as to the final settlement and
adjustment of the accounts or otherwise, or in any other way
vary or affect the CONTRACT. The final bill shall be
submitted by the CONTRACTOR within one month of the
date of physical completion of the WORK, otherwise, the
ENGINEER-IN-CHARGE's certificate of the measurement
and of total amount payable for the WORK accordingly shall
be final and binding on all parties
91.1 Should CONTRACTOR consider that he is entitled to any
extra payment or compensation or to make any claims
whatsoever in respect of Work, he shall forthwith give notice
in writing to the Engineer-in-Charge and to the Employer by
"Registered Post with acknowledgement" within 10 days
from the ordering of any work or happening of any event
upon which the Contractor's bases of such claim and such
notice shall contain full particulars of the nature of such claim
with full details and amounts claimed. Further,
CONTRACTOR shall quantify the claim within 30 days of
such notice, clearly indicating the extent of liability on the
part of GAIL. The Contractor along with quantified claims
should also submit documents supporting the claim so
quantified to both Employer and to Engineer-in-Charge.
Failure on the part of CONTRACTOR to put forward any
claim with the necessary particulars as above within the time
specified shall be an absolute waiver thereof and the
CONTRACTOR shall be debarred from raising any further
claim(s) and/or dispute (s) after the expiry of the said
specified period. No omission by EMPLOYER to reject any
