Following penalty criteria are applicable for SLA violation: In Case of monthly service availability of the link is o Below 99.0% & up to 97.0% for any link/links, 10% of the monthly recurring service charge for that/those link/links will be deducted. o Below 97% & up to 95% for any link/links, 20% of the monthly recurring Service charge for that/those link/links will be deducted. o Below 95% for any link/links, Monthly Recurring Service will not be paid for that/those link/links. 2. In case, in three consecutive months, Monthly Service Availability of any link/links goes below 95%, owner shall have the right to de-hire that specific link/links. 3. Service provider will maintain cumulative service availability above 95% in any quarter. In case the service provider fails to maintain this required service availability 2 times in the service contract period, GAIL has the right to terminate the contract with Service Provider after the 2 nd such failure 9. Payment Terms a) Paying Authority Payment will be made from the following paying authority on certification of invoice by Engineer-in-Charge. TENDER NO.: GAIL/ND/C&P-MKTG/GT/14/2007 The payment against each link/ connectivity shall be “recurring service charge” for that link, which will be comprised of all the charges like bandwidth charges plus rental of customer premises equipment (CPE) for that link plus last mile charges, if any etc. The payment against the same link will be released at the end of every month inline with the SLA on the submission of the following. a) Invoice/bills, duly certified by Engineer-in-charge. b) Monthly available Report of the link for the billing period, duly certified by Engineer-in-Charge or his designated representative. c) Mode of submission of invoice On completion of the services for each month and fulfilling other obligations stipulated in the contract, request(s) for payment shall be made by Service Provider to owner in writing accompanied by the invoice (s) & required documents as mentioned above. Services Provided….………….. d) No interest charges for delay in payment, if any, shall be borne by owner. e) GAIL (INDIA) Limited has initiated payments to suppliers electronically and to facilitate payments electronically, the Bidder should have an account with State Bank of India or HDFC bank or ICICI Bank with e-banking platform, so that the payment through ebanking be made to the Bidder, in case order is placed. Further, the Bidder should give the details of his bank account in any one of the above banks to facilitate payment through e-banking in case of placement of order on him. 10. INSTRUCTIONS TO THE SERVICE PROVIDERS • All the expenditure for boarding, lodging, traveling, transport of material to GAIL Site, out of pocket expenses etc. shall be borne by the service 37
