9. Right <strong>of</strong> Employer to<br />

Accept or Reject Tender:<br />

duplicate prior to the date <strong>of</strong> opening <strong>of</strong> the tenders to clarify<br />

documents or to reflect modification in design or CONTRACT<br />

terms.<br />

8.2 Each addenda/ corrigendum issued will be issued in duplicate to<br />

each person or organisation to whom set <strong>of</strong> Tender Documents<br />

has been issued. Recipient will retain tenderer's copy <strong>of</strong> each<br />

Addendum/Corrigendum and attach original copy duly signed<br />

along with his <strong>of</strong>fer. All Addenda/Corrigenda issued shall<br />

become part <strong>of</strong> Tender Documents.<br />

9.1 The right to accept the tender will rest with the EMPLOYER.<br />

The EMPLOYER, however, does not bind himself to accept the<br />

lowest tender, and reserves to itself the authority to reject any or<br />

all the tenders received without assigning any reason whatsoever.<br />

The whole work may be split up between more than one<br />

CONTRACTORS or accept in part (not entirely) if considered<br />

expedient. Quoted rates should hold good <strong>for</strong> such eventualities.<br />

Tenders in which any <strong>of</strong> the particulars and prescribed<br />

in<strong>for</strong>mation are missing or are incomplete in any respect<br />

and/or the prescribed conditions are not fulfilled are liable to<br />

be rejected. The Tender containing uncalled <strong>for</strong> remarks or<br />

any additional conditions are liable to be rejected.<br />

Canvassing in connection with tenders is strictly prohibited<br />

and tenders submitted by the Tenderers who resort to<br />

canvassing will be liable to rejection.<br />

10. Time Schedule 10.1 The WORK shall be executed strictly as per the TIME<br />

SCHEDULE specified in TENDER/CONTRACT Document.<br />

The period <strong>of</strong> construction given in Time Schedule includes the<br />

time required <strong>for</strong> mobilisation as well as testing, rectifications if<br />

any, retesting and completion in all respects to the entire<br />

satisfaction <strong>of</strong> the ENGINEER-IN- CHARGE.<br />

10.2 A joint programme <strong>of</strong> execution <strong>of</strong> the WORK will be<br />

prepared by the ENGINEER-IN-CHARGE and CONTRACTOR<br />

based on priority requirement <strong>of</strong> this project. This programme<br />

will take into account the time <strong>of</strong> completion mentioned in 10.1<br />

above and the time allowed <strong>for</strong> the priority works by the<br />

ENGINEER-IN-CHARGE.<br />

10.3 Monthly/Weekly construction programme will; be drawn up<br />

by the ENGINEER-IN-CHARGE jointly with the<br />

CONTRACTOR, based on availability <strong>of</strong> work fronts and the<br />

joint construction programme as per 10.2 above. The<br />

CONTRACTOR shall scrupulously adhere to these targets<br />

/programmes by deploying adequate personnel, construction tools<br />

and tackles and he shall also supply himself all materials <strong>of</strong> his<br />
