TENDER NO.: GAIL/ND/C&P-MKTG/GT/14/2007 SPECIAL TERMS AND CONDITIONS OF CONTRACT 1. Special Terms & Conditions: The following special terms and conditions of the contract will supplement the General Condition of Contract. Whenever there is a conflict, the provision herein shall prevail over those in the General Conditions 1. Supplier will be totally responsible for the offered services including last mile connectivity, CPE, other hardware and software etc as detailed elsewhere in the tender document. It will be expressly understood that the specifications are given as presently envisaged to meet the objectives. Service provider may improve upon these specifications if desired to do so to meet the service requirement and network availability as per the SLA. However, no extra payment will be made for such additional job for improvement. 2. All the deliverables by the service provider and the work necessary to carry out to establish the connectivity will meet the requirement and specifications as defined elsewhere in the tender document. The design and workmanship will satisfy the applicable standards, specifications and codes. 3. In case last mile to be provided through radio communication, necessary frequency clearance and SACFA clearance from the statutory authority as per law of the land will be taken by the service provider and they will maintain the same during the complete service contract period. 4. All the equipments which will be deployed for providing the required connectivity shall conform to the latest standards of ITU-T, ITU-R, ETSI, IEC, ISO, EIA etc. 5. The equipment will be immune to EMI/RFI interference generated by any other nearby source and will not cause EMI/RFI interference by either emission or conduction to other electrical and electronic equipment collocated with service provider’s equipment. They shall meet the latest international standards in this regard. 6. All the equipments used should be rugged enough to work in non-air conditioned environment. 30
TENDER NO.: GAIL/ND/C&P-MKTG/GT/14/2007 7. The equipments used will be such that dust, insects, termites and other foreign materials can not enter inside the equipments. 8. The quoted price will include all recurring costs for bandwidth charges and rental against the systems & equipments used to provide the connectivity, civil, mechanical, electrical or any jobs for providing services and facilities to GAIL. 9. If during the course of execution of the services, any discrepancy or inconsistency, error or omission in any of the contract condition is discovered which needs to be clarified, the matter will be referred to the owner who will give decision in the matter and his decision will be final and conclusive. 10. Engineer-in-charge (EIC) will be indicated at the time of award of work. 11. The service provider will carry out various tests as required to ensure performance of the work. No separate payment will be made for this. 12. For all tests either in field or at GAIL’s premises, service provider at his own cost will carry out concerning the executions of the services. 13. Any hardware/software not conforming to the specifications, codes or standard engineering practices will be rejected forthwith and the service provider will carry out the rectification at his own cost. 14. Service provider will within 7 days, after receipt of the LOI will provide the schedule plan to start services. 15. Service provider will observe in addition to codes specified in respective specification all national and local laws, ordinances, rules and regulation and requirements pertaining to the supply/work and services and service provider will be responsible for extra costs arising from violations of the same. 16. Service provider will carry out required supervision and inspection as required to establish the VPN link/connectivity. 17. The interfaces available from GAIL end for SCADA flow computer and router for respective sites are as per Annexure-I and Annexure-II. 31
