TENDER NO.: GAIL/ND/C&P-MKTG/GT/14/2007 18. The owner will claim all costs of damages or expenses that the owner may have paid, for which under the contract the service provider is liable. All such claims will be billed by the owner to the service provider regularly as & when they fall due. Such bills shall be supported by appropriate & certified vouchers or explanations, to enable the service provider to properly identify such claims which shall be paid by service provider within 15 days of the receipt of corresponding bills. If such amount is not paid by the service provider within the said period, the owner may then deduct the amount, from any amount due or becoming due to the service provider under the contract which may be recovered by actions of law or otherwise, if the service provider fails to satisfy the owner for such claims. 19. Various procedures and method to be adopted by Service Provider during the setting up of desired connectivity at various GAIL locations shall be submitted to owner in due course of time for approval. No such implementation activity shall commence unless approved by owner in writing. 20. Bidder will provide all the details of their equipment etc installed at GAIL` s premises, if GAIL desired to see those. 21. Without assigning any reason, GAIL shall have the right to surrender any or all the link/connectivity by giving a notice period of one month to the service provider. 22. The payments are subject to bidder having furnished the contract cum equipment performance bank guarantee for 10% of the contract amount, within 30 days of notification of award of contract from owner. 2. Installation Condition: The Bidder will ensure that no other equipment/structure/setup gets damaged due to their activities. Any damages if caused to GAIL` s property due to Bidder` s negligence will be pass on to the Bidder` s account. 3. Delivery 32
TENDER NO.: GAIL/ND/C&P-MKTG/GT/14/2007 The time schedule for design, engineering, setting up, testing and commissioning of the links/connectivity as per “Connectivity Requirement”, as mentioned else where in this document, in totality is 30 days from the date of Fax of Intent (FOI). 4. Contract Period The contract service period for providing required connectivity and maintaining the same as per service level agreement (SLA) will be initially for a period of two years from the date of commissioning and will be extendable for another six months on the same terms and conditions if GAIL desired to extend the contract.However, GAIL reserves the right to terminate links partially or fully under the contract with notice period of one month. 5. Installation: All the pre-requisites regarding site readiness has to be clearly intimated to GAIL in advance and if felt needed, Bidder can visit the sites in advance and check for the readiness for power, housing, installation/operation etc of the systems at sites. 6. Installation responsibilities: Service provider will submit the installation report along with systems configuration report, results of diagnostic tests run etc to GAIL. Installation report has to be submitted by the service provider mentioning all the serial numbers of installed hardware & software along with the required valid licenses if any applicable. At the end of the implementation of connectivity, while commissioning the links, the consolidated report mentioning the same needs to be submitted to EIC in the form of hard and soft copies. For setting up of end to end connectivity by service provider, GAIL will provide space & 230 V AC single phase, 50 Hz raw power at all the locations. Uninterrupted power supply required for hardware to be arranged by the service provider.
