ARTICLE 4<br />

Are you in favor <strong>of</strong> <strong>the</strong> adoption <strong>of</strong> Amendment No. 3 as proposed by<br />

<strong>the</strong> Planning Board to amend Article 1 Section 1.6 Definitions, by (1) adding<br />

definitions for "Tower": Shall mean any structure that is designed and<br />

constructed primarily for <strong>the</strong> purpose <strong>of</strong> supporting one or more antennas,<br />

including self-supporting lattice towers, guy towers, or monopole towers.<br />

term includes radio and television transmission towers, microwave towers,<br />

common-carrier towers, cellular telephone towers, alternative tower structures,<br />

and <strong>the</strong> like.<br />

This term does not include amateur radio operator's equipment, as<br />

licensed by <strong>the</strong> FCC. "Alternative tower structure": Innovative siting techniques<br />

that shall mean man-made trees, clock towers, bell steeples, light poles, and<br />

similar alternative-design mounting structures that camouflage or conceal <strong>the</strong><br />

presence <strong>of</strong> antennas or towers.<br />

"Amateur Radio Tower": A structure that is not<br />

used for human occupancy, which contains no heated space, which exceeds <strong>the</strong><br />

height <strong>of</strong> 35 feet, yet does not exceed 65 feet in height, and is utilized<br />

exclusively for amateur purposes.<br />

"Antenna" :<br />

Shall mean any exterior apparatus designed for telephonic, radio,<br />

television, personal communications services (PCS), pager network, or any<br />

o<strong>the</strong>r communications through <strong>the</strong> sending and/or receiving <strong>of</strong> electromagnetic<br />

waves <strong>of</strong> any bandwidth. "FAA" : An abbreviation that shall mean <strong>the</strong> Federal<br />

Aviation Adrninistration. "FCC": An abbreviation that shall mean <strong>the</strong> Federal<br />

Communications Commission. "Height": When referring to a tower or o<strong>the</strong>r<br />

antenna support structure, means <strong>the</strong> vertical distance from grade plane to <strong>the</strong><br />

highest point <strong>of</strong> <strong>the</strong> support structure, even if such highest point is an antenna or<br />

o<strong>the</strong>r appurtenance."; and "Telecommunications Facilities: Shall mean any<br />

structure, antenna, tower, or o<strong>the</strong>r devise which provides commercial mobile<br />

wireless services, unlicensed wireless services, cellular phone services,<br />

specialized mobile radio communications (SMR), and personal communications<br />

service (PCS), and common carrier wireless exchange access services"; (2)<br />

deleting Section III 3.39 and replacing it with number 3.39.1 to be re-titled<br />

"Amateur Radio Towers"; and (3) replacing Article XVI with <strong>the</strong> new<br />

Telecommunications Facility Ordinance which will read as follows:<br />

TELECOMMUNICATIONS FACILITY ORDINANCE<br />

16.1 PURPOSE AND GOAL: The general purpose <strong>of</strong> this ordinance is to<br />

preserve <strong>the</strong> authority <strong>of</strong> <strong>the</strong> <strong>Town</strong> <strong>of</strong> <strong>Hampton</strong> to regulate and provide for<br />

reasonable opportunity for <strong>the</strong> siting <strong>of</strong> telecommunication facilities. Any such<br />

facilities shall not exceed 100 feet in height.<br />
