ARTICLE 39<br />

Shall <strong>the</strong> <strong>Town</strong> authorize <strong>the</strong> Board <strong>of</strong> Selectmen, pursuant to<br />

RSA<br />

41:1 1-a, Management <strong>of</strong> <strong>Town</strong> Real Property, to lease town owned property,<br />

not covered under <strong>the</strong> authorization granted in 1982, at Map 287 Lot 028, Map<br />

287 Lot 18-A, Map 175 Lot 13, for a period <strong>of</strong> more than one year.<br />

Seconded by Brian Warburton<br />

The article was explained by Frederick Rice and he also gave <strong>the</strong><br />

location <strong>of</strong> <strong>the</strong> property.<br />

Mr. Arthur Moody questioned <strong>the</strong> absence <strong>of</strong> maps showing <strong>the</strong><br />

location <strong>of</strong> <strong>the</strong> property. He cited a 1990 <strong>Town</strong> meeting vote requiring that a<br />

map be available whenever a parcel <strong>of</strong> land is to be sold or leased. He also noted<br />

that <strong>the</strong> lot numbers needed fur<strong>the</strong>r qualification and that <strong>the</strong> second lot (at <strong>the</strong><br />

Dolphin Motel) was under a current lease not to expire for ano<strong>the</strong>r eight years.<br />

Mr. Moody <strong>the</strong>n produced a map showing <strong>the</strong> property lines involved.<br />

Mr. Moody <strong>of</strong>fered <strong>the</strong> following amendment to clarify <strong>the</strong> article<br />

"Shall <strong>the</strong> <strong>Town</strong> authorize <strong>the</strong> Board <strong>of</strong> Selectmen, pursuant to RSA 41:1 1-a,<br />

Management <strong>of</strong> <strong>Town</strong> Property, to lease <strong>Town</strong>-owned property for a period <strong>of</strong><br />

no more than 15 years, such property not being covered under <strong>the</strong> authorization<br />

granted in 1982 for <strong>the</strong> traditional leased land in <strong>the</strong> beach, and such leases<br />

being continued with <strong>the</strong> restrictions <strong>of</strong> being for parking and beautification<br />

purposes only with no structures at Tax map 287, Lot 28 (Brown Avenue<br />

Extension) and at Tax Map 175, Lot 013-002 (in front <strong>of</strong> <strong>the</strong> <strong>the</strong>aters for 350<br />

feet, being <strong>the</strong> <strong>Town</strong>'s old street railway right-<strong>of</strong>-way)?" Seconded by Jason<br />

Page.<br />

The Moody Amendment passed and <strong>the</strong> Moderator Walker stated that<br />

Article 39 would go on <strong>the</strong> ballot as amended.<br />
