day <strong>of</strong> delinquency from his salary by the Board <strong>of</strong> County Commissioners<br />

; and if it shall appear to the s<strong>at</strong>isfoction <strong>of</strong> the County Board<br />

<strong>of</strong> Health th<strong>at</strong> the de<strong>at</strong>h <strong>of</strong> any person from the spread <strong>of</strong> the disease<br />

can justly be <strong>at</strong>tributed to such failure <strong>of</strong> duty on his part, he shall be<br />

deposed from <strong>of</strong>fice and a successor immedi<strong>at</strong>ely elected to fill out his<br />

unexpired term. Any person neglecting or refusing to comply with or<br />

in any way viol<strong>at</strong>ing the rules promulg<strong>at</strong>ed in the manner above set<br />

forth on the subjects <strong>of</strong> quarantine and disinfection shall be deemed<br />

guilty <strong>of</strong> a misdemeanor, and upon conviction shall be fined or imprisoned,<br />

<strong>at</strong> the discretion <strong>of</strong> the court, not less than five nor more than<br />

fifty dollars, or less than ten nor more than thirty days. In case the<br />

<strong>of</strong>fender be stricken with the disease for which he is quarantinable, he<br />

shall be subject to the penalty on i-ecovery, unless in the opinion <strong>of</strong><br />

the Superintendent it should be omitted : Provich-d, hoirerer, th<strong>at</strong> in any<br />

city or incorpor<strong>at</strong>ed town having a regularly appointed medical health<br />

<strong>of</strong>ficer who is a member <strong>of</strong> the County Board <strong>of</strong> Health, the duties<br />

assigned in this section to the County Superintendent <strong>of</strong> Health shall be<br />

performed by the said medical health <strong>of</strong>ficer for the people <strong>of</strong> his city<br />

or town, and he shall be subject to the same penalties for dereliction <strong>of</strong><br />

duty <strong>at</strong> the hands <strong>of</strong> the Board <strong>of</strong> Aldermen or Town Commissioners as<br />

are directed to be imposed by the County Commissioners and County<br />

Board <strong>of</strong> Health upon the Superintendent: Frotided further, th<strong>at</strong> the<br />

quarantine <strong>of</strong> ports shall not be interfered with, but the <strong>of</strong>ficers <strong>of</strong> the<br />

local and St<strong>at</strong>e Boards shall render all aid in their power to quarantine<br />

<strong>of</strong>ficers in the discharge <strong>of</strong> their duties upon the request <strong>of</strong> the l<strong>at</strong>ter:<br />

Provided, tli<strong>at</strong> the custody and care <strong>of</strong> any child or other person may<br />

remain in custody <strong>of</strong> parent or family.<br />

Sec. 10. Wiien a householder knows th<strong>at</strong> a person within his family<br />

is sick with either <strong>of</strong> the diseases enumer<strong>at</strong>ed in section nine he shall<br />

immedi<strong>at</strong>ely give notice there<strong>of</strong> to the health <strong>of</strong>ficer or Mayor, if he<br />

resides in a city or incorpor<strong>at</strong>ed town, otherwise to the County Superintendent<br />

<strong>of</strong> Health, and upon the de<strong>at</strong>h or recovery or removal <strong>of</strong> such<br />

person the rooms occupied and the articles used by him shall be disinfected<br />

by such householder in the manner indic<strong>at</strong>ed in Section Nine.<br />

Any person neglecting or refusing to comply with any <strong>of</strong> the above provisions<br />

shall be deemed guilty <strong>of</strong> a misdemeanor, and upon conviction<br />

shall be fined not less than one dollar nor more than fifty dollars.<br />

Sec. 11. When a physician knows th<strong>at</strong> a person whom he is called to<br />

visit is infected with small-pox, diphtheria, scarlet fever, typhus fever,<br />

yellow fever or cholera he shall immedi<strong>at</strong>ely give notice there<strong>of</strong> to the<br />

health <strong>of</strong>ficer or :\Iayor, if the sick person be in a city or incorpor<strong>at</strong>ed<br />

town, otherwise to the County Superintendent <strong>of</strong> Health, and if he<br />

refuses or neglects to give such notice <strong>of</strong> it in tv\enty-four hours he shall<br />

be guilty <strong>of</strong> a misdemeanor and shall be fined for each <strong>of</strong>fen-e not less
