u majority did not meet. If there was no lawful meeting there was no<br />
legal election. Wlien the County Board fails to meet, as authorized by<br />
law, the Board <strong>of</strong> Commissioners must elect a Superintendent. A majority<br />
<strong>of</strong> the Board <strong>of</strong> Health <strong>of</strong> Perquimans county did not meet, so the letter<br />
st<strong>at</strong>es, and did not elect Dr. J. T. Smith to the <strong>of</strong>fice <strong>of</strong> Superintendent,<br />
therefore th<strong>at</strong> <strong>of</strong>fice has never been legally lilled. It is vacant now and<br />
must be filled in accordance with section 5, chapter 214, Laws <strong>of</strong> <strong>1893</strong>.<br />
<strong>The</strong> County Commissioners must therefore, if they have not already done<br />
so, elect the Superintendent.<br />
With reference to the other questions in the letter, permit me to say<br />
th<strong>at</strong> I will answer them <strong>at</strong> any time they may become practical, or whenever<br />
you deem it<br />
necessary for me to do so.<br />

In accordance with this opinion the County Commissioners<br />
elected Dr. J. W. Speight, the present incumbent,<br />
the<br />
Board <strong>of</strong><br />
same gentleman th<strong>at</strong> had been chosen by the County<br />
Health.<br />
In view <strong>of</strong> this decision <strong>of</strong> the Attorney General it is <strong>of</strong><br />
gre<strong>at</strong> importance th<strong>at</strong> the physicians <strong>of</strong> the St<strong>at</strong>e should<br />
not forget when the time for the next meeting to elect a<br />
Superintendent arrives on the first Monday in September,<br />
1895, th<strong>at</strong> a majority must be present to make a legal<br />
quorum.<br />
WATER AND WATER SUPPLIES.<br />
During the year a number <strong>of</strong> analyses <strong>of</strong> w<strong>at</strong>er under<br />
permit <strong>of</strong> the Board have been kindly made for us by<br />
St<strong>at</strong>e Experiment St<strong>at</strong>ion, Dr. H. B. B<strong>at</strong>tle, Director.<br />

mentioning those devoid <strong>of</strong> special interest I will call<br />
<strong>at</strong>tention to those <strong>of</strong> the two extremes. A sample from the<br />
deep well system recently j^ut in <strong>at</strong> the St<strong>at</strong>e Hospital <strong>at</strong><br />
Morganton showed a w<strong>at</strong>er <strong>of</strong> singular purity. In the<br />
words <strong>of</strong> the chemist, "it is refreshing to see such an analysis."<br />
