w<strong>at</strong>er .sni)ply and dis}n)sal <strong>of</strong> sewage, and no contraet sliall be entered<br />
into by any St<strong>at</strong>e institution, city or town for the introduction <strong>of</strong> a system<br />
<strong>of</strong> w<strong>at</strong>er supply or sewage dis})osal until said advice shall have<br />
been received and considered: Pruriiled, Jiou-frcr, th<strong>at</strong> any city or town<br />
having a regularly organized Board <strong>of</strong> Health may seek advice therefrom<br />
or from its County Boai'd <strong>of</strong> Health in lieu <strong>of</strong> th<strong>at</strong> <strong>of</strong> the St<strong>at</strong>e Board.<br />
Sec. 20. "Whoever willfully or maliciously defiles, corrupts or makes<br />
impure any well, spring or otlier .source <strong>of</strong> w<strong>at</strong>er supply or reservoir, or<br />
destroys or injures any pii)e, conductor <strong>of</strong> w<strong>at</strong>er or other property pertaining<br />
to an aqueduct, or aids and abets in any such trespass, shall be<br />
guilty <strong>of</strong> a misdemeanor, and on conviction shall be fined not exceeding<br />
one thousand dollars or imprisoned not exceeding one year.<br />
Sec. 21. Any hou.seholder in whose family there is to his knowledge a<br />
person sick <strong>of</strong> cholera or typhoid fever, who shall permit the bowel discharges<br />
<strong>of</strong> such sick person to be emptied without first having disinfected<br />
them according to the instructions to be obtained from the <strong>at</strong>tending<br />
physician or the County Superintendent <strong>of</strong> Health shall be guilty <strong>of</strong><br />
a misdemeanor, and upon conviction shall be fined not less than two nor<br />
more than twenty-five dollars, or imprisoned not less than ten norjnore<br />
than thirty days. And in cases where such undisinfected discharges are<br />
emptied on the w<strong>at</strong>er shed <strong>of</strong> any stream or pond furnishing the source<br />
<strong>of</strong> w<strong>at</strong>er supply <strong>of</strong> any public institution, city or town the penalty .shall<br />
be a fine <strong>of</strong> not less than twenty-five nor more than fifty dollars, or<br />
imprisonment for not more than thirty days. And any i)hysician <strong>at</strong>tending<br />
a case <strong>of</strong> cholera or typhoid fever who refuses or neglects to give the<br />
proper instructions for such disinfection as soon as the diagnosis is made<br />
shall be deemed guilty <strong>of</strong> a misdemeanor, and upon conviction shall be<br />
fined not less than ten nor more tlian fifty dollars.<br />
Sec. 22. Whenever and wherever a nui.sance upon premises shall exist<br />
which in the opinion <strong>of</strong> the County Superintendent <strong>of</strong> Health is dangerous<br />
to the public health, it shall be his duty to notify in writing the<br />
parties occupying the premises (or the owner, if the premises are not<br />
occupied) <strong>of</strong> its existence, its character and the means <strong>of</strong> ab<strong>at</strong>ing it.<br />
X^pon<br />
this notific<strong>at</strong>ion the pjarties shall proceed to ab<strong>at</strong>e the nuisance, but failing<br />
to do this shall be adjudged guilty <strong>of</strong> a misdemeanor and shall pay a<br />
fine <strong>of</strong> one dollar a day d<strong>at</strong>ing from twenty-four hours after the notific<strong>at</strong>ion<br />
has been served, the amounts so collected to he turned over to the<br />
County Treasurer: Prodded, hoiren'r, th<strong>at</strong> if the party notified shall<br />
make o<strong>at</strong>h or afiirm<strong>at</strong>ion before a justice <strong>of</strong> the peace <strong>of</strong> his or her<br />
inability to carry out the directions <strong>of</strong> the Superintendent it shall 1)6<br />
done <strong>at</strong> the expense <strong>of</strong> the town, citj' or county in which the <strong>of</strong>fender<br />
lives.<br />
In the l<strong>at</strong>ter case the limit <strong>of</strong> the expense chargeable to the town^<br />
city or county shall not be more than one hundred dollars in any case:<br />
