Original Text Clarification needed Clarification of Western Railway This Para is self explanatory and should be read in totality. Tender condition remain unchanged. (ii) This certificate in the pro-forma given in Form No. 7, shall accompany the offer. Absence of this certificate which will form part of the agreement shall disqualify the tenderer automatically. 72 Chapter-4 SCC 4.21 Alstom GPROGRAMME OF WORK EXECUTION (i) Time is the essence of this contract and time schedule shall be strictly adhered to. The entire work as per the Contract will have to be completed within Eighteen months from the Date of issue of acceptance letter, on a progressive basis. The Tenderer will be responsible for progress of work on progressive basis from the date of issue of acceptance letter. Since the progress of the work is critically related to the supply of material by the contractor, he will be responsible for supply of duly inspected Material on a progressive basis, so that the work can be completed within Eighteen months progressively. We understand that Work shall be completed in phases and Purchaser shall put to use the Work in phases. Kindly confirm. This Para is self explanatory and should be read in totality. No. Firm T Original Text Clarification needed Clarification of Western Railway y p (ii) Contractor on his part will have to employ supervisors, technicians and supporting staff in full strength commensurate with working area available. He will also arrange required materials and equipment to complete the job most expeditiously so as to ensure that the work is completed in phases within the stipulated period and to the entire satisfaction of Engineer in- charge. (iii) The Contractor is expected to have worked out a detailed programme for execution of the work well before issue of “Letter of Acceptance”, by Railway and submit a Detailed Time and Activity Schedule within 30 days from issue of LoA , for the execution of work aiming at completing the entire work within the stipulated completion time. This schedule shall thereafter be approved by the Engineer-In-Charge normally within 5 working days. (iv) Railway reserves the right to modify the schedule while approving the same as well as at any stage during execution if situation so warrants. Once approved, in the event of any slippage from the time schedule especially when resulting into time over-run of the work the contractor shall submit revised schedule duly justifying the circumstances without any delay. The revised schedule shall be approved by the Engineer-In-Charge only when considered justified in his opinion otherwise it may attract penal action on the contractor as per provision of this contract. (v) The Contractor shall be held responsible for the execution of the work according to the Programme given for the execution of the work in full compliance of the approved cable route plans and also various clauses of technical specification and requirement.
