i.The contractor shall guarantee that all material &
equipment to be supplied and installed as per this
contract shall be free from defect and fault in
design, material, workmanship and manufacture
and shall be of the highest grade and consistent
with established and generally accepted standard for
materials of the type ordered and in full conformity
with the contract specification.
ii.During the period of Warranty the contractor shall
be responsible to the extent expressed in this
clause for any defects that may develop under the
conditions provided for by the contractor and under
proper use, arising from faulty materials, design or
workmanship on the plant or from faulty erection of
the equipments under the supervision of the
contractor, but not to do so by the purchaser who
shall state in writing in what the portion is faulty
iii.This tender shall guarantee that the material/
equipment supplied will continue to conform to the
specification and quality, as covered in this tender,
for a period of Five Years. Final Acceptance
Certificate and this warranty shall survive,
notwithstanding the fact that, the material /
equipment may have been inspected, accepted and
payment therefore made by the Railways.
Our understanding is that if any part of the
works is put in use by the Purchaser before
completion of the entire work then warranty
for such part or Phase of the works shall
cease 5 years from the date on which such
part or Phase was put to use. Kindly confirm
Warranty for a period of Five years
will start from date of commissioning
of complete system and issue of
Final Acceptance Certificate.
