Original Text Clarification needed Clarification of Western Railway The prices shall include all taxes, duties, Royalty land levies (including Octroi etc.) applicable to this Works Contract. Therefore, they should quote their prices taking into account the rate of sales tax as leviable in the event of sale to the Central Government Organization etc. It is clarified that required form applicable for this purpose will be supplied to the contractor, as applicable in the state where the contract is being executed. The prices shall also include provision for losses and wastage in transit and installation and commissioning. The prices quoted by the tenderer shall include cost of commissioning and testing and all costs of Administration of Contract, Insurance, Premium banker‟s charges for guarantees, cost of storage, loading-unloading and handling of materials and for any road transport which the contractor may use or carriage of materials to his depot and the site of work. The prices shall include the cost of works and adjustments necessary to be done by the contractor during or after test carried out by the purchaser. We understand that change in law, statute, tax rate etc. coming into effect after the date for submission of tender. Our understanding is that any increase/decrease in cost on account of any change in law statute, tax rate etc. or introduction of any new law, statute, tax etc. after the submission of tender shall be passed on to the Purchaser. Contractor shall provide documentary evidence of the increase or decrease to Purchaser. This Para is self explanatory and should be read in totality & Tender Condition remain unchanged. No. Firm T Original Text Clarification needed Clarification of Western Railway y p The Unit prices offered against the various items in schedules will include beside labour the following elements of cost:- (i) Cost of all materials required for preparing the cable routes, laying the cables and all other incidentals connected therewith excluding the materials supplied by the Railways. (ii) Special tools & installation materials for TPWS equipments, racks, wiring etc. (iii) Cost of transportation of material, supplied by the Railway from place of delivery to the site of work. (iv) Return of released materials, left over cables and other materials from the site of work and handing over to the Engineer at specified locations or stores depot. (v) Cost of preparation of detailed documentation completion plans/drawings. (vi) All other miscellaneous expenses necessary for the execution of work and fulfillment of contractual obligation. 82 Chapter-4 SCC 4.64 Alstom GSETTLEMENT OF DISPUTES Arbitration & conciliation ordinance 1996 / Arbitration Act, 1996 with latest circular or corrigendum will be valid for this tender. We suggest disputes be settled by arbitration under the Rules of Arbitration of the International Chamber of Commerce by three arbitrators appointed in accordance with the said Rules. And the place of arbitration should be neutral venue. We propose Singapore or London. Tender Condition remain unchanged. The successful tenderer/s shall put up his/their claim as per clause 43 of the General Conditions of The provision of Clauses 63 & 64 to the General Condition of Contract will be applicable only for settlement of claims or disputes between the parties for values less than or equal to 20% of the value of the contract, and when claim or disputes are of value more than 20% of the contract, provision of Clauses 63 & 64 and other relevant clauses of the General Conditions of Contract will not be applicable and arbitration will not be a remedy for settlement of such disputes.
