The congress requested for strengthening the implementation of the professional ethic by
considering critical roles of professional boards (medical, dental, midwives, pharmacist, and
nurse board) and local authority, by further requesting the local authority and professional
boards to strictly implement their roles and responsibilities based on collaborative, justice and
independent principle. Gender issue, control of private sector including clinics and
pharmacies were also discussed.
11. Doctor Tea Kim Chhay, Director of the Drug-Food-Medical Equipment and Cosmetic
Department reported to the congress the status of the gender in the Ministry of Health since
the establishment of the working group for gender in 2006. The awareness and knowledge in
gender, focusing on progress, equity and equality had been disseminated to leaders and
officials and staff of the Ministry of Health. The congress noted that the technical and
financial support to gender activities is still limited, like the inclusion of gender into strategy
and annual operational plan of each institution of the Ministry. The congress appealed for
closer collaboration between PHD and relevant institutions as well as the local authority.
12. The congress also discussed the issue related to the control of private sectors, including
clinics and pharmacy/depots. The congress noted that currently some legislative documents
concerning the establishment and functioning as well as controlling private sectors, like law
on running private professional business, sub-decree on procedure and criteria for running
private business, prakass on social marketing have been developed and ratified as well as
disseminated and the committee to control the private sectors at all levels have been
established and functioning. As result, the number of unregistered private business decrease
notably.
Concerning the unregistered pharmacy/depot as well as counterfeit drugs that currently have
advert impacts on people health was also discussed. The congress agreed on the strategy to
eradicate the counterfeit drugs through strengthening and re-enforcing the implementation of
legislations and regulations, strengthening the monitoring and punishment for any uncompliance.
The congress also suggested the importance of professional morality and
professional ethic, inter-ministries collaboration, and active participation and collaboration of
the private sectors itself. It was noticed that the solution the above-mentioned issues is
specifically difficult and complicated, especially to ban the illegal clinic and illegal
ambulance services. Based on the responsibility and compliance principles, all leaders and
officials of the Ministry of Health at all levels, local authorities and the relevant individual
participating in the congress commit to eradicate all illegal phenomenon with suggesting
strengthening collaboration and support from local authorities as well as moral and financial
support to the implementation.
The congress agreed that the basic weapon to eradicate the illegality of private sectors is the
decision of the Royal Government signed by Samdach Hun Sen, the Prime Minister of the
Royal Government establishing the committee to eradicate the counterfeit drugs and illegal
private health care facilities by re-enforcing: 1) awareness raising through dissemination of
educational messages; 2) administrative procedures; and 3) judiciary procedure. The congress
requested to speed up the process in establishing committee in 5 provinces that have not had
the committee yet. H.E. Doctor Sok Pheng, Under-Secretary of State for Health shared with
the congress the experiences in managing hospital through the establishment of council for
discipline which has role in motivating or punishing those who commit wrong doing against
law/regulation with active participation from PHD.
