AN ORDINANCE<br />
GRANTING A SPECIAL USE FOR A RESTAURANT <br />
CAJUN JOE'S - 1316 N. RAND ROAD <br />
BOARDWALK PLAZA SHOPPING CENTER <br />
WHEREAS, pursuant to a petition and public hearing, held on<br />
July 9, 1991, <strong>of</strong> which public notice was given as required by law,<br />
the Zoning Board <strong>of</strong> Appeals <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Palatine</strong>, in<br />
accordance with the Municipal Code <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Palatine</strong>,' in<br />
such case made and provided has held such public hearing regarding<br />
granting a special use for a Cajun Joe's Premium chicken Restaurant<br />
pursuant t~<br />
Sec. 11.03 D (25) <strong>of</strong> the <strong>Palatine</strong> Zoning ordinance, on<br />
the following legally described property:<br />
That part <strong>of</strong> the N.W. 1/4 <strong>of</strong> Sec. 12, Township 42 North, Range<br />
10 East <strong>of</strong> the Third Principal meridian, lying S.W. <strong>of</strong> the<br />
center-line <strong>of</strong> Rand Road, 1,062.84 ft. Northwesterly <strong>of</strong> the E.<br />
line <strong>of</strong> the N.W. 1/4 <strong>of</strong> said Sec. 12, as measured along said<br />
center-line; thence southwesterly at right angles, 290.0 feet;<br />
thence northwesterly parallel with said center-line, 185.0<br />
feetr then southwesterly perpendicular to last described line,<br />
10.0 feet;thenoe southwesterly along a curved line 298.45<br />
feet convex to the west having a radius <strong>of</strong> 190 feet thence<br />
southeasterly along a line parallel with said center-line<br />
133.50 feet: thence northeasterly 290.0 feet along a line<br />
perpendicular to said center-line to a point which is 328.50<br />
feet southeasterly <strong>of</strong> the point <strong>of</strong> beginning; thence<br />
northwesterly along oenter-line <strong>of</strong> Rand Road 328.50 feet to<br />
the point <strong>of</strong> beginning (except the northeasterly 50.0 feet<br />
there<strong>of</strong>) in Cook county, Illinois<br />
(hereinafter sometimes called the "subject property").<br />
NOW, THEREFORE, BE IT ORDAINED, by the President and Board <strong>of</strong><br />
Trustees <strong>of</strong> the <strong>Village</strong> <strong>of</strong> <strong>Palatine</strong>, Cook County, Illinois, acting<br />
in the exercise <strong>of</strong> their home rule power, that:<br />
SECTION 1:<br />
A special use for a restaurant is hereby granted<br />
for the subject property, pursuant to section 11.03 D (25) <strong>of</strong> the<br />
<strong>Palatine</strong> Zoning Ordinance, subject to the following conditions:<br />
1. The Special Use is granted solely to Cajun Joe's Real<br />
Estate Corporation and Kenneth Ritzenthaler and Phillip<br />
Rizzo <strong>of</strong> RCJ Enterprises, Ino., petitioner and lessee,<br />
and may be transferred only after review by the Zoning<br />
Board <strong>of</strong> Appeals and consent <strong>of</strong> the <strong>Village</strong> Board. In<br />
the event <strong>of</strong> the sale <strong>of</strong> this business and/or the<br />
granting <strong>of</strong> a transferenoe <strong>of</strong> a lease restaurant in this<br />
location only, the existing and prospective owners shall<br />
appear before a public meeting <strong>of</strong> the Zoning Board <strong>of</strong><br />
Appeals. The Zoning Board <strong>of</strong> Appeals shall review the<br />
request and in its sole discretion shall either:<br />
1.1. Recommend that the <strong>Village</strong> Board approve <strong>of</strong> the<br />
transfer <strong>of</strong> the lease and/or ownership to the new
