AN ORDINANCE
GRANTING A SPECIAL USE FOR A RESTAURANT
CAJUN JOE'S - 1316 N. RAND ROAD
BOARDWALK PLAZA SHOPPING CENTER
WHEREAS, pursuant to a petition and public hearing, held on
July 9, 1991, of which public notice was given as required by law,
the Zoning Board of Appeals of the Village of Palatine, in
accordance with the Municipal Code of the Village of Palatine,' in
such case made and provided has held such public hearing regarding
granting a special use for a Cajun Joe's Premium chicken Restaurant
pursuant t~
Sec. 11.03 D (25) of the Palatine Zoning ordinance, on
the following legally described property:
That part of the N.W. 1/4 of Sec. 12, Township 42 North, Range
10 East of the Third Principal meridian, lying S.W. of the
center-line of Rand Road, 1,062.84 ft. Northwesterly of the E.
line of the N.W. 1/4 of said Sec. 12, as measured along said
center-line; thence southwesterly at right angles, 290.0 feet;
thence northwesterly parallel with said center-line, 185.0
feetr then southwesterly perpendicular to last described line,
10.0 feet;thenoe southwesterly along a curved line 298.45
feet convex to the west having a radius of 190 feet thence
southeasterly along a line parallel with said center-line
133.50 feet: thence northeasterly 290.0 feet along a line
perpendicular to said center-line to a point which is 328.50
feet southeasterly of the point of beginning; thence
northwesterly along oenter-line of Rand Road 328.50 feet to
the point of beginning (except the northeasterly 50.0 feet
thereof) in Cook county, Illinois
(hereinafter sometimes called the "subject property").
NOW, THEREFORE, BE IT ORDAINED, by the President and Board of
Trustees of the Village of Palatine, Cook County, Illinois, acting
in the exercise of their home rule power, that:
SECTION 1:
A special use for a restaurant is hereby granted
for the subject property, pursuant to section 11.03 D (25) of the
Palatine Zoning Ordinance, subject to the following conditions:
1. The Special Use is granted solely to Cajun Joe's Real
Estate Corporation and Kenneth Ritzenthaler and Phillip
Rizzo of RCJ Enterprises, Ino., petitioner and lessee,
and may be transferred only after review by the Zoning
Board of Appeals and consent of the Village Board. In
the event of the sale of this business and/or the
granting of a transferenoe of a lease restaurant in this
location only, the existing and prospective owners shall
appear before a public meeting of the Zoning Board of
Appeals. The Zoning Board of Appeals shall review the
request and in its sole discretion shall either:
1.1. Recommend that the Village Board approve of the
transfer of the lease and/or ownership to the new
