ORDINANCE NO. ___<br />

AN ORDINANCE GRANTING A SPECIAL USE AND VARIATIONS<br />

1280-1286 E. DUNDEE ROAD (CASE NO. 12-36)<br />

WHEREAS, pursuant to a petition and public hearing on June 12, 2012 <strong>of</strong><br />

which public notice was given as required by law, the Zoning Board <strong>of</strong> Appeals <strong>of</strong><br />

the <strong>Village</strong> <strong>of</strong> <strong>Palatine</strong>, in accordance with the Zoning Ordinance <strong>of</strong> the <strong>Village</strong> <strong>of</strong><br />

<strong>Palatine</strong>, in such case made and provided, has held such public hearing and<br />

reported their findings relative to a request for a Special Use to permit a restaurant<br />

pursuant to Section 11.03 (d) (28) <strong>of</strong> the <strong>Palatine</strong> Zoning Ordinance; a Variation to<br />

permit a freestanding sign <strong>of</strong>240 square feet instead <strong>of</strong> the maximum permitted 100<br />

square feet pursuant to Section 8.03 (c) (1) (c) (i) <strong>of</strong> the <strong>Palatine</strong> Zoning Ordinance; a<br />

Variation to permit a freestanding sign that does not display the name and location<br />

<strong>of</strong> the unified center pursuant to Section 8.03 (c) (1) (b) <strong>of</strong> the <strong>Palatine</strong> Zoning<br />

Ordinance; a Variation to permit attached signage for an individual store to be 137<br />

square feet instead <strong>of</strong> the maximum permitted 98 square feet pursuant to Section<br />

8.03 (c) (2) (c) (i) <strong>of</strong>the <strong>Palatine</strong> Zoning Ordinance; and a Variation to permit three (3)<br />

attached signs for an individual store instead <strong>of</strong>the maximum permitted one (1) Sign<br />

pursuant to Section 8.03 (c) (2) (a) <strong>of</strong>the <strong>Palatine</strong> Zoning Ordinance, on the following<br />

legally described property.<br />

That part <strong>of</strong> the Southeast % <strong>of</strong> Section 1, Township 42 North, Range 10 East<br />

<strong>of</strong> the Third Principal Meridian described as follows:<br />

Commencing at the South % corner <strong>of</strong>said Section; thence North 00 degrees<br />

00 minutes 00 seconds East along the North-South centerline <strong>of</strong>said section a<br />

distance <strong>of</strong> 98.85 feet to the intersection <strong>of</strong> said line and the North right-<strong>of</strong>way<br />

line <strong>of</strong> Dundee Road; thence South 89 degrees 59 minutes 28 seconds<br />

East along the North right-<strong>of</strong>-way line <strong>of</strong> Dundee Road a distance <strong>of</strong> 200.00<br />

feet to the point <strong>of</strong> beginning; thence North 00 degrees 00 minutes 00<br />

seconds East a distance <strong>of</strong> 400.00 feet; thence North 89 degrees 54 minutes<br />

03 seconds East a distance <strong>of</strong> 186.00 feet; thence North 00 degrees 00<br />

minutes 00 seconds East a distance <strong>of</strong> 101.65 feet; thence North 89 degrees<br />
