3. The Special Use to permit the operation of Tony's Pizza Peddlers shall be
granted solely to Nikolai V. Chavoulev, lessee, and shall be transferred only
after a review by the Zoning Board of Appeals and approval of the Village
Council. In the event of the sale or lease of this property, the existing and
prospective proprietors shall appear before a public meeting of the Zoning
Board ofAppeals. The Zoning Board of Appeals shall review the request and
in its sole discretion, shall either:
a. Recommend thatthe Village Council approve ofthe transfer ofthe lease
and/or ownership to the new proprietor without amendment to the Special Use
Ordinance, or
b. If the Zoning Board of Appeals deems that the new proprietor
contemplates a change in use which is inconsistent with this Special Use
Ordinance, the new proprietor shall be required to petition for a public hearing
before the Zoning Board of Appeals for a new Special Use Ordinance.
4. The kitchen hood suppression system shall be replaced in a manner
acceptable to the Fire Prevention Bureau.
5. The hours of operation shall be limited to the hours between 8 am and 2 am
Monday to Sunday.
SECTION 2: That the petition for Special Use, a copy ofthe public notice and
the report of the hearing be attached hereto and form a part of this ordinance.
SECTION 3: That this ordinance shall be in full force and effect from and after
its passage and approval as provided by law.
