Legislation that applies to <strong>asbestos</strong> removal53. The Dangerous Goods Order allows a class B-licensed removalist to remove<strong>asbestos</strong> that is not fixed or <strong>in</strong>stalled only if that removal is associated withor derived from the removal of non-friable ACM that is fixed to or <strong>in</strong>stalled <strong>in</strong>a build<strong>in</strong>g, structure, ship or plant. This enables a class B-licensed removalistto collect debris associated with a:• non-friable removal they are perform<strong>in</strong>g• non-friable removal <strong>in</strong>appropriately performed by other people.54. The Dangerous Goods Order also allows employers or self-employed personsthat are not licensed removalists to remove <strong>asbestos</strong> that is not fixed or<strong>in</strong>stalled if it:(a) is related to the removal of fixed or <strong>in</strong>stalled <strong>asbestos</strong> permitted underregulation 4.3.45 of the Regulations, and(b) does not constitute more than ‘a m<strong>in</strong>or contam<strong>in</strong>ation’.55. In relation to 53 (a), this means any debris associated with the removal (presentor past) of non-friable fixed or <strong>in</strong>stalled ACM may be performed by a personthat is not a licensed <strong>asbestos</strong> removalist. The person who performs theremoval must still be appropriately tra<strong>in</strong>ed and perform the removal <strong>in</strong> a safemanner.56. In relation to 53 (b), this means if the <strong>asbestos</strong> to be removed is greater thana m<strong>in</strong>or contam<strong>in</strong>ation, a class A-licensed removalist is required. If it is a m<strong>in</strong>orcontam<strong>in</strong>ation, a licensed removalist is not required but the person whoperforms the removal must still be appropriately tra<strong>in</strong>ed and perform theremoval <strong>in</strong> a safe manner.What is a m<strong>in</strong>or contam<strong>in</strong>ation?The term ‘m<strong>in</strong>or contam<strong>in</strong>ation’ is not def<strong>in</strong>ed <strong>in</strong> the Regulations.
