Legislation that applies to <strong>asbestos</strong> removalAsbestos-contam<strong>in</strong>ated dust62. A m<strong>in</strong>or contam<strong>in</strong>ation of <strong>asbestos</strong>-contam<strong>in</strong>ated dust is where:(a) for the entire removal job, the <strong>asbestos</strong>-contam<strong>in</strong>ated dust can beremoved with<strong>in</strong> a period of time not exceed<strong>in</strong>g 10 m<strong>in</strong>utes <strong>in</strong> total andthe total cumulative time over which all <strong>asbestos</strong>-contam<strong>in</strong>ated dust jobsundertaken does not exceed one hour <strong>in</strong> any period of seven days. Wherethese time limits have been or are likely to be exceeded (consider job startand f<strong>in</strong>ish times <strong>in</strong> paragraphs 60 and 61), the job is greater than a m<strong>in</strong>orcontam<strong>in</strong>ation and a class A-licensed removalist is required, or(b) an <strong>in</strong>dependent and competent person determ<strong>in</strong>es that <strong>asbestos</strong>contam<strong>in</strong>ateddust constitutes a m<strong>in</strong>or contam<strong>in</strong>ation (even when thetime limits <strong>in</strong> (a) are likely to be exceeded). When mak<strong>in</strong>g a decision,the <strong>in</strong>dependent and competent person must act <strong>in</strong> accordance with theRegulations and consider the likelihood of airborne levels of <strong>asbestos</strong>exceed<strong>in</strong>g half the exposure standard dur<strong>in</strong>g the removal process.Asbestos-contam<strong>in</strong>ated dust that is a m<strong>in</strong>or contam<strong>in</strong>ationAn employer has two employees carry<strong>in</strong>g out an <strong>asbestos</strong>-contam<strong>in</strong>ated dustclean-up for five m<strong>in</strong>utes each as a ‘one-off’ task. The total (cumulative) timespent by the employer is 10 m<strong>in</strong>utes. Because this ‘one-off’ task can beperformed with<strong>in</strong> a period of time not exceed<strong>in</strong>g 10 m<strong>in</strong>utes <strong>in</strong> total, theremoval is considered a m<strong>in</strong>or contam<strong>in</strong>ation and the employer is not requiredto have a licence.Asbestos-contam<strong>in</strong>ated dust that exceeds a m<strong>in</strong>or contam<strong>in</strong>ation(i) A large warehouse has surfaces covered <strong>in</strong> <strong>asbestos</strong>-contam<strong>in</strong>ated dust.The dust has come from the <strong>asbestos</strong> cement roof which has s<strong>in</strong>ce beenenclosed with a false ceil<strong>in</strong>g. The total job would take more than 10m<strong>in</strong>utes. The removal exceeds a m<strong>in</strong>or contam<strong>in</strong>ation and the DangerousGoods Order requires a class A-licensed removalist to carry out this work.(ii) An employer has two employees that service a number of <strong>workplaces</strong>. Partof their work <strong>in</strong>volves carry<strong>in</strong>g out <strong>in</strong>cidental <strong>asbestos</strong>-contam<strong>in</strong>ated dustclean-up for up to five m<strong>in</strong>utes each time they perform a particular task.The task does not require removal of fixed or <strong>in</strong>stalled ACM. The numberof these tasks performed each week can vary from none to 20. The total(cumulative) time over which removal of <strong>asbestos</strong>-contam<strong>in</strong>ated dust isundertaken by the employer occasionally exceeds one hour <strong>in</strong> a periodof seven days (ie five m<strong>in</strong>utes per task multiplied by 20 tasks equatesto 100 m<strong>in</strong>utes), therefore the removal exceeds a m<strong>in</strong>or contam<strong>in</strong>ation.The Dangerous Goods Order requires that a class A-licensed removalistcarry sout this removal work.<strong>WorkSafe</strong> <strong>Victoria</strong> <strong>Compliance</strong> code / <strong>Remov<strong>in</strong>g</strong> <strong>asbestos</strong> <strong>in</strong> <strong>workplaces</strong> 17
