Paraoccupational air monitor<strong>in</strong>g andclearance <strong>in</strong>spectionsWho is an <strong>in</strong>dependent person <strong>in</strong> relation to the clearance certificate?423. An <strong>in</strong>dependent person is someone who is <strong>in</strong>dependent from the licensedremovalist and from the person who commissioned the removal work.This person must not be <strong>in</strong> a position of conflict with their <strong>in</strong>dependenceof judgement and <strong>in</strong>tegrity <strong>in</strong> relation to their <strong>in</strong>spection activity. Anyonewho has a conflict of <strong>in</strong>terest or a vested <strong>in</strong>terest <strong>in</strong> declar<strong>in</strong>g there is novisible <strong>asbestos</strong> residue rema<strong>in</strong><strong>in</strong>g would not be considered <strong>in</strong>dependent.An <strong>in</strong>dependent person can not be a director, employee or person witha pecuniary <strong>in</strong>terest.424. In some cases, a consultant may be engaged to manage a project.Where this consultant commissions the removalist, they can not takeon the role of the <strong>in</strong>dependent person to issue the clearance certificate.425. An <strong>in</strong>dependent person must have the requisite knowledge, skills andexperience to undertake visual <strong>in</strong>spections. This means they must have:• knowledge of the <strong>asbestos</strong> removal <strong>in</strong>dustry and the Regulations• the ability to identify what is or what may be ACM• the ability to thoroughly <strong>in</strong>spect the area for suspect material• experience <strong>in</strong> <strong>asbestos</strong> removal work, <strong>in</strong>spection of <strong>asbestos</strong> removal areasor audits of <strong>workplaces</strong> for ACM that is relevant to the visual <strong>in</strong>spection tobe performed (eg friable or non-friable ACM, the type of structure or plantfrom which ACM was removed)• the ability to <strong>in</strong>terpret paraoccupational air monitor<strong>in</strong>g reports for friableremoval work (where required).426. The person propos<strong>in</strong>g to engage the <strong>in</strong>dependent person should considerask<strong>in</strong>g for referees and examples of clearance certificates issued for otherremoval work. They should also ask the <strong>in</strong>dependent person what process theywill be undertak<strong>in</strong>g to assist <strong>in</strong> determ<strong>in</strong><strong>in</strong>g whether this person’s knowledge,skills and experience are appropriate.427.
