Regulatoryprohibitions24. The Regulations conta<strong>in</strong> prohibitions made under the Occupational Healthand Safety Act 2004 (the OHS Act) – which apply to <strong>workplaces</strong>; and theDangerous Goods Act 1985 (Dangerous Goods Act) – which apply to allpersons. Guidance <strong>in</strong> relation to the prohibitions made under the OHS Act iscovered below. There is guidance on prohibitions made under the DangerousGoods Act <strong>in</strong> <strong>WorkSafe</strong>’s Manag<strong>in</strong>g <strong>asbestos</strong> <strong>in</strong> <strong>workplaces</strong> compliance code.Prohibitions under the Occupational Health and SafetyAct 2004 (regulation 4.3.7 to 4.3.9)Prohibitions on <strong>asbestos</strong> removal25. Asbestos must not be removed from a workplace unless the <strong>asbestos</strong>removal work:• is conducted by a licensed removalist• is conducted by an employee of a person who is a licensed removalist• <strong>in</strong>volves non-friable ACM with an area that does not exceed 10 squaremetres <strong>in</strong> total and the total time of all <strong>asbestos</strong> removal by the employer(<strong>in</strong>clud<strong>in</strong>g all employees) does not exceed one hour <strong>in</strong> any period of sevendays, or• is for the purpose of sampl<strong>in</strong>g and identification (see Appendix C of<strong>WorkSafe</strong>’s Manag<strong>in</strong>g <strong>asbestos</strong> <strong>in</strong> <strong>workplaces</strong> compliance code for more<strong>in</strong>formation on sampl<strong>in</strong>g and identification).Contam<strong>in</strong>ated cloth<strong>in</strong>g26. Cloth<strong>in</strong>g contam<strong>in</strong>ated with <strong>asbestos</strong> must not be removed from the workplaceexcept for disposal or launder<strong>in</strong>g. When cloth<strong>in</strong>g is removed from the workplaceto be laundered, it should be placed <strong>in</strong> two 200 micron-thick plastic bags(ie double bagged) and labelled to identify the presence of <strong>asbestos</strong>. Cloth<strong>in</strong>gneeds to be wet down before bagg<strong>in</strong>g to m<strong>in</strong>imise the potential for airbornedust to be generated when the bag is re-opened. The launderer must be toldabout the potential for <strong>asbestos</strong> contam<strong>in</strong>ation on the cloth<strong>in</strong>g prior to arrivalat the laundry.27.
