Generalrequirements ofthe OccupationalHealth and SafetyRegulations 2007Duty to control exposure to airborne <strong>asbestos</strong> fibres14. People with management or control of a workplace as well as employers andself-employed persons have duties to control exposure to airborne <strong>asbestos</strong>fibres <strong>in</strong> the workplace.15. They must elim<strong>in</strong>ate the exposure to airborne <strong>asbestos</strong> fibres so far as isreasonably practicable. If exposure cannot be elim<strong>in</strong>ated, they must reducethe exposure so far as is reasonably practicable.16. There are also duties to:• ensure that no person is exposed to an atmospheric concentration of<strong>asbestos</strong> fibres above the <strong>asbestos</strong> exposure standard (see def<strong>in</strong>itionon page 8)• determ<strong>in</strong>e the exposure of employees if there is uncerta<strong>in</strong>ty• ensure copies of the results of any atmospheric monitor<strong>in</strong>g are accessibleto any affected employees at the workplace and their HSRs.17. The duties of both the person with management or control and the employerextend to all people at the workplace (not just employees), <strong>in</strong>clud<strong>in</strong>g<strong>in</strong>dependent contractors and their employees.Management or controlThe person who has management or control can be the person who:• owns a workplace but is not at or based at that workplace (it does nothave to be that person’s actual place of work)• has legally been assigned management and control duties over aworkplace (such as a management group that may or may not belocated at the workplace)• owns the workplace and is work<strong>in</strong>g (or has employees work<strong>in</strong>g) at thatworkplace – <strong>in</strong> this case the person is both the person with managementor control and an employer (if they have employees).<strong>WorkSafe</strong> <strong>Victoria</strong> <strong>Compliance</strong> code / <strong>Remov<strong>in</strong>g</strong> <strong>asbestos</strong> <strong>in</strong> <strong>workplaces</strong> 5
