No person shallcarry out any development or erect, re-erect or make alterations or demolishany building or cause the same to be done without obtaining a prior permissionin writing in this regard from the Authority.Provided that no permission shall be required for :-(i)(ii)(iii)(iv)Such alteration under below mentioned heads in a building, as do nototherwise violate any provisions regarding general building requirements,structural stability and fire safety requirements of these rules,-(a)(b)(c)(d)(e)(f)(g)(h)(i)(j)(k)(l)∗ (m)opening and closing of a window or door or ventilator;providing inter-communication doors;providing partitions;providing false ceilings;gardening;white washing;painting;re-tiling and repairing of roof;plastering and patch work;re-flooring;constructions of sun shades on one's own land;re-erection of portions of buildings damaged by earthquake or othernatural calamities, to the same extent and specifications as existedprior to such damage;re-erection of portion of buildings damaged by any other calamity asmay be notified by the District Collector, with the previous approvalof the State Government to the same extent and specification asexisted prior to damage.carrying out works in compliance with any order or directions made by anyauthority under any law for the time being in force;carrying out works by any authority in exercise of its powers under any lawfor the time being in force;carrying out by the Central or the State Government or any local authority anywork:-∗Notification No. F-II (I) 93. dated 13-1-93, Gazette dt. 15.4.93. inserted16
M.P.Bhumi Vikas Niyam, <strong>1984</strong>(v)(vi)(vii)(viii)(a)(b)required for the maintenance or improvement of a highway, road orpublic street, being works carried out on land within the boundaries ofsuch highway, road or public street;for the purpose of inspecting, repairing or renewing any drains, sewers,mains, pipes, cables, telephone or other apparatus including thebreaking open of any street or other land for that purpose:Provided that no work which would entail breaking open any street shall beundertaken without prior intimation to the Authority :The erection (including wells) made in the ordinary course of agriculturaloperation.The construction of a road intended to give access to land solely foragricultural purpose;The normal use of land which has been used temporarily for otherpurpose like marriage pandals, or for festive occasions; andIn case of land, normally used for no purpose or occasionally used, forany purpose, the use of land for the other purpose or occasions, notinvolving permanent diversion or diversion for substantial period;1 Provided also that in the case of a high rise building no permission shall be givensave with express clearance given by the following site clearance committee asthe case may be consisting of the following members namely:-2 (A) Site clearance committee within Municipal Corporation area :–(1) Divisional Commissioner Chairman(2) District Collector Member(3) Superintendent of Police Member(4) Municipal Commissioner Member(5) Superintendent Engineer/Executive Engineer of PWD Member(B&R)(6) Divisional Engineer of the respective jurisdiction the MemberMadhya Pradesh.
