Continuation of <strong>City</strong> Ordinance11-006 ,'page 2~:ORDINANCE AMENDING AND SUPPLEMENTING CHAER 53 (PERSONNEL) OFTHE JERSEY CITY MUNICIPAL CODE, IMPLEMENTING ARTICLE XIII (RETIREEHEALTH AN MEDICA BENEFITS) TO 1) ENROLL ALL RETIREES IN APREFERRD PROVIDER OR DIRECT ACCESS PLA OR 2) REQUIRE ALL RETIREESTO PAY TO RETAIN OR ENROLL IN A TRAITIONAL HEALTH BENEFITS PLAWHE~AS, it is not only fai and reasonable but critical to the economic integrty of the <strong>City</strong>'shealth benefits sJ'stem, to.also remove retiees from the Traditional Pla or requie them to pay thecost differential to reta it; andWHEREAS, upon removal from the Traditional Plan the <strong>City</strong>'s retiees wicontiue to receive,the same hih level of health benefits that the <strong>City</strong> provides to its active employees though thePrefered Provider or Direct Access Plas; andWHERES, retiees wi contiue to receive health benefits though a Preferred Provider or DirectAccess Plan, at the same level of provided to active employees and no cost tothem, even thoughthe <strong>City</strong>'s active employees are no~ requied to pay' at least 1.5% of the annual cost thereof; andWHEREAS, accordigly, effective March 1,2011 the <strong>City</strong> of<strong>Jersey</strong> <strong>City</strong> shall only pay the cost fora Preferred Provider or Direct Access Health Pla for its retiees; however, any present retieeswishig to reta or eIÌoll in a Tradition' Plan, may elect to do so if they pay the cost differenti ofa Traditional Plan.NOW, THEREFORE, BE IT ORDAINED by the Municipal Counci of the <strong>City</strong> of<strong>Jersey</strong> <strong>City</strong>.that:A. The followig amendmtnts and supplements to Chapter 53 (personnel) and of the <strong>Jersey</strong><strong>City</strong> Code are adopted.ARTICLE XIIIRetiee Medical and Health Benefits§53-84 Retiee Medical and Health Benefits Plans.Effective March 1,2011, the <strong>City</strong> wi no longer offer a Traditional Indemnity Health aridMedical Insurance Plan (Traditional Pla) and pay the costs thereof, for any retied employee. Alpresent and futue retiees wi be automaticaly enrolled in a Preferred Provider or Direct AccessHealth Plan or the substati equivalent thereof. Those employees who have retied, may elect toreta or enroll in a Traditional Plan but only if the they pay any diference between the cost fora Tràditional Pla and the cost for a Preferred Provider or Direct Access Health Insurance Plans,as calculted by the <strong>City</strong> each year.B. All ordiances and parts of ordiances inconsistent herewith are hereby repealed.C. Ths ordiance shal be a part of the <strong>Jersey</strong> <strong>City</strong> Code as though codified and fuy set forththerein. The <strong>City</strong> Clerk shal have ths ordiance codified and incorporated in the officialcopies of the <strong>Jersey</strong> <strong>City</strong> Code.D. Ths ordiance shal tae effect at the tie and in the maner as provided by law.E. .
