PassageORDINANCEOFJERSEY CITY, N.J.COUNCIL AS AWHOLEoffered and moved adoption of the following, ordinance;TITLE:CITY ORDINANCE 11-010ORDINANCE AúTHORIZING 1) TIl SALE OF CERTAIN UNIMPROVED PROPERTYIN JERSEY CITY, KNOWN AS BLOCK 1600, LOT F; BLOCKI627, LOTS 7AND8, AND 'BLOCI( 1623, LOT S;l, TOJC BROADWAY, LLC ("JCB") FOR AN INGRESS ANDEGRESS EASEMENT AT THE SITE;AND 2).ANDÌNG THE GRAT AGREEMENTWITH THE PORT AUTHORITY OF NEW YORKW JERSEY CONCERNING THEPJP/SIEGEL ACQUISITIONTHE MUNICIPAL COUNCIL OF THE CITY OF JERSEY CITY DOES ORDAIN:WHEREAS, the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> is the ovmer of certain unimproved propert in <strong>Jersey</strong> <strong>City</strong>known as Block 1600, Lot F, Block 1627, Lots 7 & 8, and Block 1623, Lot S.1 consisting ofapproximately 10,000 square feet and depicted on the map attched hereto as Exhbit A (Propert);andWHEREAS, the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> has no municipal public need for the Propert; andWHEREAS, NJSA40A: 12-13(a)(5) of the Local Lands and Buildings Law authorizes the sale of<strong>City</strong> owned propert to the owner of the real property contiguous to the real propert being sold;provided that the propert being sold is less than thethe muncipal zoning ordinance and is without any capital improvement thereon;.'-minimum size required for development underandWHEREAS,any such sale shall be for not less than fair market value of the Propert; andWHEREAS, ic BROADWAY, LLC ("JCB") is an entity that ownsreal propert contiguous to thePropert and needs an access easement across the propert in order to maintain its business; andWHEREAS, the Propert being sold is less than theminimum sizerequired for development underthe muncipal zoning ordinance and is without any capital improvement thereon, Within the meaningof NJSA. 40A:12-13(a)(5); and 'WHEREAS, the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> is willing to convey an easement oVer the propert'uponpaymentto the <strong>City</strong> of the sum of$129,200 the <strong>City</strong> by JCB, LLC; anda park, and 'WHEREAS, the easement Propert is a par of a larger tract of land located along Routes 1 & 9knowIlas the PJP!Siegel Landfill, which the <strong>City</strong> acquired in 2009 to be converted into open spaceandWHREAS, pursuat to Resolution 09-290, the <strong>City</strong> executed a Memofiidum of Agreement"MOA" between <strong>City</strong>çf <strong>Jersey</strong> <strong>City</strong> and the Port Authonty of New York & New <strong>Jersey</strong>, on'April24,2009 and received a $4,OOO,00Ò grant frçim the Port Authority of New York & New <strong>Jersey</strong>; tomaintan the propert as open space; and'WHEREAS, pursuant to the MOA, the <strong>City</strong> must seek wrtten consent from the Port Authority ofNYINJ fòr any use of the Property that violates the terms of the restrctive covenant; and
