Gas transport and metering rates<br />

With Resolution ARG/gas no. 176/10 the Authority specified<br />

the procedures for <strong>com</strong>pensating amounts deriving<br />

from the use of rates specified for a smaller number of areas<br />

than those used for the conferral of transport capacity<br />

for the 2009-<strong>2010</strong> gas year. The <strong>com</strong>pensation mechanism<br />

regards the January-September <strong>2010</strong> period.<br />

At the end of 2009, with Resolution ARG/gas no. 184/09,<br />

the Authority set transport and metering rates for <strong>2010</strong>-<br />

2013, partially amending the rate structure for the previous<br />

regulatory period. With Resolution ARG/gas no.<br />

192/09, the Authority established the new procedures for<br />

allocating all gas lots not subject to metering on transport<br />

networks, including unaccounted-for gas (UFG), to users.<br />

On the basis of these measures, the Authority then issued<br />

Resolution ARG/gas no. 198/09 approving the reference<br />

rates for <strong>2010</strong>, providing for a larger increase in transport<br />

rates than the national average for users who import gas<br />

from the network entry points.<br />

In April <strong>2010</strong> <strong>Enel</strong> Trade appealed Resolutions ARG/gas<br />

nos. 184/09, 192/09 and 198/09.<br />

Pending the hearing, the Authority issued Resolution<br />

ARG/gas no. 218/10 approving the transport and metering<br />

rates for 2011. <strong>Enel</strong> Trade has also appealed that<br />

measure.<br />

Gas Exchange and the daily balancing market<br />

Article 30 of Law 99/09 of July 23, 2009 charges the Energy<br />

Markets Operator (EMO) with the financial management<br />

of the natural gas market (Gas Exchange), in accordance<br />

with rules prepared by the EMO and approved by the<br />

Ministry for Economic Development, and provides for the<br />

acceptance of gas purchase and sale offers by the EMO on<br />

an economic merit basis.<br />

Pursuant to Article 30, paragraph 2, the Minister for Economic<br />

Development issued a decree on March 18, <strong>2010</strong>,<br />

establishing the procedures for the EMO to use, as from<br />

May 10, <strong>2010</strong>, in managing transactions in gas lots imported<br />

from non-EU countries subject to the mandatory<br />

offer requirement, later regulated by Resolution ARG/gas<br />

no. 58/10. The decree establishes that the EMO shall take<br />

on the role of sole central counterparty.<br />

With a decree of August 6, <strong>2010</strong>, the Minister for Economic<br />

Development provided for the sale, on the platform<br />

operated by the EMO, of the in-kind royalties due to<br />

the State by natural gas producers in Italy, governed by<br />

Resolution ARG/gas no. 132/10. The gas trading platform<br />

launched on May 10, <strong>2010</strong>, for transactions in imported<br />

gas and royalty gas provided for the offer of monthly/annual<br />

products without the EMO acting as a counterparty.<br />

On December 10, <strong>2010</strong>, the EMO launched the Gas Exchange<br />

for the trading of spot products, taking on the role<br />

of central counterparty.<br />

In December <strong>2010</strong>, the Authority opened its guidelines for<br />

the introduction of a gas balancing market and physical<br />

and financial settlement among the parties involved up to<br />

consultation (DCO no. 45/10 and DCO no. 46/10).<br />

Allocation criteria<br />

With Resolution ARG/gas no. 62/09 the Authority initiated<br />

a review of the criteria used to allocate gas among users<br />

of the transport system’s shared redelivery points. The<br />

current procedure, established under Article 29 of Resolution<br />

no. 138/04 and extended once to September 30,<br />

<strong>2010</strong>, was extended again to September 30, 2011, with<br />

Resolution ARG/gas no. 27/10.<br />

With the same resolution, the Authority established a new<br />

calculation method for daily allocation of gas withdrawn<br />

by customers not subject to daily metering. The procedure,<br />

which will be valid for the period October <strong>2010</strong> - September<br />

2011, will also be applied in recalculating transport<br />

and storage fees paid by users in the period October 1,<br />

2007 - September 30, <strong>2010</strong>.<br />

The adjustment payments in respect of such fees for the<br />

2007-2008 and 2008-2009 gas years will be made by the<br />

end of February 2011. Those for the 2009-<strong>2010</strong> gas year<br />

will be made in the first few months of 2011.<br />

Late metering adjustments<br />

With Resolution ARG/gas no. 182/09, the Authority established<br />

the criteria for settling payments arising in respect<br />

of late adjustments of metering data for final direct customers<br />

of the transport network. With Resolution ARG/<br />

gas no. 70/10, the scope of application was extended to<br />

the shared city-gates in cases where the late adjustments<br />

do not give rise to reallocations. As from July <strong>2010</strong>, halfyearly<br />

netting sessions will be conducted at a regulated<br />

monthly price to cover the cost of raw materials and transport.<br />

Coverage of gas social rate costs and energy efficiency<br />

measures<br />

With Resolution ARG/gas no. 177/10, the Authority established,<br />

as from January 1, 2011, the application of the<br />

GS and RE fees to end users connected to the transport<br />

network. The fees are intended to finance, respectively,<br />
