The “Metodología para la determinación de los cargos<br />

correspondientes a los servicios de transmisión que preste<br />

la CFE a los generadores renovables” was also approved.<br />

This document sets the transmission services rates for<br />

<strong>2010</strong>, to be revised annually. The high and medium-voltage<br />

rate was set at $2.20/MWh and the low-voltage rate<br />

at $4.30/MWh. These rates cover use of the infrastructure,<br />

losses, services connected with transmission and a fixed<br />

<strong>com</strong>ponent for contract administration. The new methodology<br />

provides an incentive for eligible renewable projects<br />

in an amount that varies based on the voltage level.<br />

Peru<br />

Renewable energy support law<br />

On February 12, <strong>2010</strong>, the first auction for the sale of energy<br />

from renewable resources was held under the law to<br />

promote renewable energy resources (Legislative Decree<br />

1002 of May 2008).<br />

The tender, which is run by the regulator OSINERG-<br />

MIN (Organismo Supervisor de la Inversión en Energía y<br />

Minería), ended with the selection of a total capacity of<br />

around 410 MW, for which it awarded 20-year contracts<br />

to supply electricity to the SEIN (Sistema Eléctrico Interconectado<br />

Nacional) at a rate equal to the price resulting<br />

from the auction for each project (denominated in US dollars/MWh).<br />

The capacity was assigned as follows:<br />

> 161 MW to 17 hydroelectric projects, with bids of between<br />

$50 and $70/MWh;<br />

> 142 MW to three wind projects, with bids of between<br />

$65 and $87/MWh;<br />

> 80 MW to four photovoltaic projects, with remuneration<br />

of between $215 and $225/MWh;<br />

> 27 MW to two biomass projects, with bids of between<br />

$52 and $110/MWh.<br />

Since the capacity to be allocated in <strong>2010</strong> was set at 500<br />

MW, the difference between that capacity and the amount<br />

awarded on February 12 will be allocated in a new auction<br />

scheduled for July 23, <strong>2010</strong>. That auction will be dedicated<br />

to generation from biomass (419 GWh), photovoltaic<br />

(8 GWh) and hydroelectric (no more than 338 MW).<br />

On July 23, <strong>2010</strong>, the second auction of renewables generation<br />

capacity for <strong>2010</strong> was held (500 MW total, 410<br />

MW of which already awarded on February 12, <strong>2010</strong>).<br />

Renewable energy support law<br />

In December 2009, with Measure 1479/2009, the government<br />

issued rules for implementing Law 220/2008<br />

for supporting power generation from renewable energy<br />

resources. The government decision establishes that the<br />

introduction of the incentive mechanisms (quantitative<br />

requirement for electricity suppliers and a system of transferable<br />

certificates, which can be traded bilaterally or on a<br />

dedicated market) shall be subject to the approval of the<br />

European Commission. On July 9, <strong>2010</strong> an amended version<br />

of Law 220/2008 was published in the official journal<br />

(Law 139/<strong>2010</strong>). The main changes with respect to the<br />

previous legislation include:<br />

> the mandatory percentage of annual electricity output<br />

that must be generated from renewables will rise gradually<br />

from 8.3% in <strong>2010</strong> to 20% in 2020;<br />

> the penalty for suppliers who do not have the required<br />

amount of green certificates has been increased from<br />

€70 to €110 per certificate not held;<br />

> the penalty and the minimum and maximum prices of<br />

certificates will be indexed to the EU-27 inflation rate;<br />

> two green certificates per MWh of wind output until<br />

2017 (one certificate thereafter);<br />

> six green certificates per MWh of photovoltaic output.<br />

A government decision will establish the rules governing<br />

the trading of excess green certificates. Following<br />

the pre-notification of the European Commission of Law<br />

220/2008, the DG Competition re<strong>com</strong>mended proceeding<br />

with a formal notification. The initiation of the formal<br />

notification process will be handled by Romania’s Ministry<br />

of the Economy and will include the amendments presented<br />

in the new law (139/<strong>2010</strong>).<br />

National renewable energy action plan (Directive<br />

2009/28/EC)<br />

The renewable energy action plan, submitted to the European<br />

Commission, sets a target of about 42.6% for the<br />

contribution of renewable resources to final gross electricity<br />

consumption.<br />
