were held in <strong>2010</strong>. Plants with a total capacity of 481 MW<br />
were registered, of which 273 MW for integrated systems<br />
and 208 MW for ground-based systems. As regards developments<br />
in the remuneration of registered plants (subject<br />
to change in relation to the ratio between registered<br />
capacity and the capacity ceilings for each convocatoria),<br />
the feed-in tariffs declined by 5.3% for integrated systems<br />
with a capacity of up to 20 kW, by 8% for integrated<br />
systems with a capacity of more than 20 kW and 8% for<br />
ground systems.<br />
On December 15, <strong>2010</strong>, the government published the<br />
results of the fourth convocatoria of <strong>2010</strong>. Based on the<br />
capacity registered, the rates that will apply starting from<br />
the 1st Quarter of 2011 were recalculated and set as follows:<br />
for integrated systems, €313.54/MWh for plants of<br />
less than or equal to 20 kW and €278.89/MWh for those<br />
of more than 20 kW; for ground installations, €251.71/<br />
MWh.<br />
On August 6, <strong>2010</strong> Royal Decree 1003/<strong>2010</strong>, governing<br />
the payment of incentives for the use of photovoltaic systems,<br />
was published. Due to the numerous irregularities<br />
discovered during inspections of these installations, the<br />
government has established a procedure through the<br />
measure to improve the qualification process for the incentive<br />
scheme.<br />
The Comisión Nacional de Energía (CNE) will check whether<br />
certain systems identified by the Dirección General de<br />
la Política Energética y Minas (DGPEM) have installed all<br />
the <strong>com</strong>ponents required for electricity generation, upon<br />
threat of suspension of the incentive as a precautionary<br />
measure and return of payments received if found to not<br />
be in <strong>com</strong>pliance.<br />
In order to be exempt from Royal Decree 1003/<strong>2010</strong>, applicants<br />
have until October 5, <strong>2010</strong> to waive the financial<br />
terms of Royal Decree 661/2007 and instead receive the<br />
remuneration set in the first convocatoria of Royal Decree<br />
1578/2008.<br />
With the Resolution of August 6, <strong>2010</strong>, the DGPEM established<br />
that inspections will begin with those systems listed<br />
in the administrative register prior to September 30, 2008,<br />
for a total capacity of 800 MW.<br />
Under Royal Decree 1003/<strong>2010</strong>, on September 24, <strong>2010</strong><br />
CNE send requests for information to the owners of 9,041<br />
photovoltaic systems with a total capacity of 955 MW. The<br />
documentation must be submitted to CNE within two<br />
months of the receipt of the request.<br />
On October 28, <strong>2010</strong>, the Ministry of Industry announced<br />
that it had received a total of 907 applications to<br />
withdraw from the system established under Royal<br />
Decree 661/2007 (for a total capacity of 64.56 MW,<br />
substantially less than expected). The change of payment<br />
system for these plants will reduce annual system costs<br />
by €17.2 million.<br />
On November 23, <strong>2010</strong> Royal Decree 1565/<strong>2010</strong> was<br />
published. The measure governs the new remuneration<br />
system for photovoltaic plants and regulates a number of<br />
technical features of the special regime. The main provisions<br />
include the following:<br />
> <strong>com</strong>pulsory participation in control centers is extended<br />
to groups of plants exceeding 10 MW and remote metering<br />
is mandatory for plants over 1 MW;<br />
> more stringent requirements are established for the<br />
control of reactive power;<br />
> a ceiling of 25 years of useful life on the entitlement of<br />
photovoltaic plants to receive the incentive;<br />
> an extraordinary reduction of the remuneration of photovoltaic<br />
plants as from the next convocatoria equal to<br />
45% for ground systems, 5% for integrated systems of<br />
up to 20 MW and 15% for integrated systems of more<br />
than 20 MW.<br />
On December 24, <strong>2010</strong>, Royal Decree Law 14/<strong>2010</strong> was<br />
published. The legislation contains urgent measures to<br />
correct the rate deficit. Among the various initiatives, the<br />
measure sets a limit on the number of hours of operation<br />
eligible to receive the incentive for photovoltaic plants.<br />
Remuneration of wind and thermal solar plants<br />
With Royal Decree 1614/<strong>2010</strong>, published on December<br />
8, <strong>2010</strong>, certain aspects of the regulatory framework for<br />
generation by wind and thermal solar plants were amended.<br />
For wind plants, the most significant changes include:<br />
> a temporary 35% reduction (from 2011 to 2012) in the<br />
prima de referencia (reference bonus);<br />
> a ceiling on the number of hours (2,589) eligible to receive<br />
the subsidized price, with the excess receiving the<br />
market price;<br />
> no future changes in the remuneration of plants in operation<br />
and preregistered plants;<br />
> an additional 300 MW for plants that are not registered<br />
but whose “acta de puesta in marcha” came prior<br />
to May 1, <strong>2010</strong> and 600 MW for plants in the Canary<br />
Islands;<br />
> a specific tariff system for experimental plants with a<br />
total capacity up to 160 MW, with remuneration determined<br />
on the basis of the system set out in Royal Decree<br />
661/2007.<br />
