With Resolution VIS no. 162/10, the Authority initiated a<br />
proceeding against <strong>Enel</strong> Rete Gas for alleged violation of<br />
the rules governing natural gas transport metering at the<br />
delivery points on its own network.<br />
With Resolution VIS no. 110/08 of December 12, 2008,<br />
the Authority had charged <strong>Enel</strong> Rete Gas with non-<strong>com</strong>pliance<br />
in 2007 with the requirement for on-site response<br />
within 60 minutes of the call for at least 90% of calls with<br />
regard to two plants (Fraconalto and Casaleggio Boiro).<br />
With VIS no. 33/10, the Authority closed the proceeding<br />
by fining <strong>Enel</strong> Rete Gas €450,000. <strong>Enel</strong> Rete Gas appealed<br />
the ruling to the Regional Administrative Court.<br />
The ruling of the Lombardy Regional Administrative Court<br />
is pending following the hearing held on February 3, 2011.<br />
With Resolution VIS no. 17/11 of February 9, 2011, the<br />
Authority fined <strong>Enel</strong> Distribuzione €920,000 following the<br />
closure of the proceeding initiated with VIS no. 171/09 to<br />
verify whether errors had been <strong>com</strong>mitted in identifying<br />
interconnection points with the National Transmission<br />
Network and in determining the data needed to quantify<br />
fees for dispatching services.<br />
Energy efficiency<br />
In order to enable coverage of costs incurred in meeting energy<br />
efficiency requirements for 2009, with Resolution EEN<br />
no. 12/10, the Authority ordered the payment of the rate<br />
contribution due to distribution <strong>com</strong>panies. As a result, <strong>Enel</strong><br />
Distribuzione received about €93 million.<br />
With Resolution EEN no. 17/10, the Authority set the rate<br />
contribution for achievement of energy savings targets for<br />
2011 at 93.68 €/toe.<br />
With Resolution EEN no. 18/10, the Authority specified the<br />
energy efficiency targets for electricity and natural gas distributors<br />
for 2011. <strong>Enel</strong> Distribuzione was set a target of 2.6<br />
million toe, equal to about 50% of the total national target.<br />
Electric cars<br />
With Resolution ARG/elt no. 56/10 the Authority initiated<br />
a series of regulatory changes aimed at fostering<br />
the spread of electric cars. More specifically, thanks to the<br />
changes introduced with the Resolution, it will be possible<br />
to request the activation of multiple supply points to<br />
recharge electric cars in private homes, <strong>com</strong>mon areas in<br />
apartment buildings or dedicated <strong>com</strong>pany areas. Electricity<br />
drawn at these recharging points will be metered<br />
at the transport rate for low-voltage uses other than<br />
residential supply. With the same Resolution the Authority<br />
also allowed dedicated electricity supplies for heat pumps<br />
to be used to recharge electric vehicles.<br />
The initial framework of rules designed to enable the development<br />
of electric mobility was supplemented with<br />
Resolution ARG/elt no. 242/10, with which the Authority<br />
introduced a number of regulatory changes that will<br />
permit testing of different organizational/operational approaches<br />
to public recharging of electric vehicles.<br />
Smart grids<br />
With Resolution ARG/elt no. 39/10 the Authority specified<br />
the criteria for selecting investments in pilot smart<br />
grid projects, which, as already established under the Integrated<br />
Rate Code (Annex A to Resolution no. 348/07), will<br />
receive a higher rate of remuneration.<br />
Renewable Energy<br />
Italy<br />
National action plan<br />
As regards implementation of Directive 2009/28/EC on<br />
the promotion of the use of energy from renewable sources,<br />
on July 28, <strong>2010</strong> the Ministry for Economic Development<br />
sent the national renewable energy action plan to<br />
the European Commission. The plan divides the national<br />
development target between the electricity, heating and<br />
transport sectors. Specifically, for the electricity sector the<br />
plan sets a target for renewables’ contribution to gross final<br />
electricity consumption of about 26%.<br />
2009 Community Act<br />
Law 96 of June 4, <strong>2010</strong>, containing measures for the<br />
performance of obligations arising in respect of Italy’s<br />
membership in the European Communities (the 2009<br />
Community Act), sets out the enabling criteria for the implementation<br />
of Directive 2009/28/EC on the promotion<br />
of renewable resources. The measures include:<br />
> the joint promotion of energy efficiency and the use of<br />
renewable resources;<br />
> the integration of renewable resources in electricity<br />
transport and distribution networks, including support<br />
for smart grids;<br />
> the reorganization of the incentives system, with the<br />
harmonization and reordering of the provisions of the<br />
Development Act and the 2008 Finance Act.<br />
