ule it would not be used where HB was <strong>in</strong> issue<br />

or, except <strong>in</strong> one HA, where <strong>the</strong> tenant was known<br />

to be “vulnerable” (although aga<strong>in</strong> different notions<br />

of vulnerability were employed) . In some HAs, this<br />

was facilitated by a practice of requir<strong>in</strong>g officers to<br />

submit <strong>the</strong> case for us<strong>in</strong>g Ground 8 to a manager for<br />

decision . In one HA, which had been a high user of<br />

Ground 8, <strong>the</strong> teams had developed different versions<br />

of a “local law” that supported its m<strong>in</strong>imal use . In<br />

two case studies, it had been or was be<strong>in</strong>g used as<br />

a way out of <strong>the</strong> failure of previous approaches to<br />

rent <strong>arrears</strong> <strong>management</strong> . In all case landlords us<strong>in</strong>g<br />

Ground 8 <strong>the</strong>re was a general acceptance that <strong>the</strong>ir<br />

organisation could operate successfully without its<br />

use, although this might <strong>in</strong>volve a slightly higher<br />

exposure to rent <strong>arrears</strong> .<br />

Duty advisors cover<strong>in</strong>g <strong>the</strong> court used by <strong>the</strong> three<br />

Nor<strong>the</strong>rn case study HAs were concerned at <strong>the</strong><br />

<strong>in</strong>creas<strong>in</strong>g use of Ground 8 aga<strong>in</strong>st clients for whom<br />

<strong>the</strong>y acted as well as <strong>the</strong> unwill<strong>in</strong>gness of some HA<br />

officers to negotiate . All duty advisors commented<br />

that present<strong>in</strong>g hous<strong>in</strong>g officers generally lacked<br />

experience and knowledge of law and procedure,<br />

which may result <strong>in</strong> <strong>the</strong>m fail<strong>in</strong>g to achieve <strong>the</strong><br />

orders requested, and could give rise to multiple<br />

suspensions .<br />

Future policy development <strong>in</strong> this area could be<br />

usefully <strong>in</strong>formed by rout<strong>in</strong>e collection of data on<br />

<strong>the</strong> use of Ground 8 from <strong>the</strong> landlord perspective .<br />

It would be straightforward to request that landlords<br />

specify <strong>in</strong> RSR returns <strong>the</strong> number of evictions <strong>in</strong><br />

which action had been brought under Ground 8 . More<br />

generally, <strong>the</strong>re could be a case for seek<strong>in</strong>g additional<br />

data about evictions on an ongo<strong>in</strong>g basis, us<strong>in</strong>g <strong>the</strong><br />

same vehicle . This could <strong>in</strong>clude, for example:<br />

• <strong>in</strong>formation potentially shedd<strong>in</strong>g light on <strong>the</strong><br />

causes of eviction, such as <strong>the</strong> proportion of<br />

evictions where <strong>the</strong> recovery of a Hous<strong>in</strong>g Benefit<br />

overpayment had been a contribut<strong>in</strong>g factor to<br />

<strong>arrears</strong> lead<strong>in</strong>g to proceed<strong>in</strong>gs<br />

• <strong>in</strong>formation provid<strong>in</strong>g an <strong>in</strong>sight <strong>in</strong>to <strong>arrears</strong><br />

<strong>management</strong>, such as <strong>the</strong> proportion of evictions<br />

<strong>in</strong>volv<strong>in</strong>g cases where personal contact had been<br />

made with <strong>the</strong> tenant before proceed<strong>in</strong>gs had<br />

been <strong>in</strong>itiated<br />

In terms of specific research, <strong>the</strong>re is potentially<br />

much that could be learned from a longitud<strong>in</strong>al<br />

study of a cohort of households <strong>in</strong> serious <strong>arrears</strong>,<br />

with a focus on identify<strong>in</strong>g <strong>the</strong> managerial and legal<br />

processes applied .<br />
