<strong>Rent</strong> <strong>arrears</strong> <strong>management</strong> practice:<br />

a literature review<br />

As a backdrop to <strong>the</strong> orig<strong>in</strong>al research be<strong>in</strong>g<br />

undertaken with<strong>in</strong> this study a literature review has<br />

been carried out to establish <strong>the</strong> current state of<br />

knowledge on rent <strong>arrears</strong> <strong>management</strong> <strong>practices</strong><br />

toge<strong>the</strong>r with possession proceed<strong>in</strong>gs, and to<br />

identify gaps <strong>in</strong> that knowledge .<br />

Earlier studies on rent <strong>arrears</strong> <strong>management</strong> drew<br />

attention to a steep rise <strong>in</strong> possession actions<br />

seen dur<strong>in</strong>g <strong>the</strong> 1990s . For some, this was seen<br />

as result<strong>in</strong>g largely from <strong>the</strong> promotion of a<br />

performance culture with<strong>in</strong> social hous<strong>in</strong>g . Previous<br />

research on <strong>arrears</strong> <strong>management</strong> practice identified<br />

a wide range of landlord approaches . Develop<strong>in</strong>g<br />

use of IT systems has had an impact, for example,<br />

through automated and triggered responses .<br />

S<strong>in</strong>ce <strong>the</strong> early part of this decade <strong>the</strong>re has been<br />

a shift towards a more specialist model of rent<br />

collection services .<br />

As regards court action, studies have found that<br />

roughly one quarter of notices result <strong>in</strong> a court<br />

hear<strong>in</strong>g . Association practice was, not surpris<strong>in</strong>gly,<br />

varied - for example, <strong>in</strong> relation to <strong>the</strong> level of<br />

<strong>in</strong>ternal review of each claim . Provision of money<br />

advice to tenants <strong>in</strong> <strong>arrears</strong> has been found uneven<br />

and concerns have been raised about access to<br />

advice and <strong>in</strong>formation prior to court hear<strong>in</strong>gs .<br />

Studies have found a number of barriers to justice,<br />

<strong>in</strong>clud<strong>in</strong>g <strong>the</strong> <strong>in</strong>accessibility of advice services,<br />

fear of cost, language, cultural barriers and a<br />

general lack of understand<strong>in</strong>g of <strong>the</strong> implications of<br />

proceed<strong>in</strong>gs . Different factors affect <strong>the</strong> exercise of<br />

discretion by District Judges and <strong>the</strong>re is a lack of<br />

consistency <strong>in</strong> relation to outcomes across different<br />

courts and between different judges <strong>in</strong> <strong>the</strong> same<br />

court . However, it is to be noted that <strong>the</strong> relevant<br />

studies took place before certa<strong>in</strong> key <strong>in</strong>terventions,<br />

notably <strong>the</strong> implementation of <strong>the</strong> PAP .<br />

There is a lack of evidence about <strong>the</strong> use of Ground<br />

8 <strong>in</strong> England . There is some evidence about its use<br />

<strong>in</strong> Wales, where around 26% of outright possession<br />

orders obta<strong>in</strong>ed <strong>in</strong> 2006-07 were made on <strong>the</strong> basis<br />

of mandatory grounds . A Citizens Advice Bureau<br />

survey of 26 English <strong>association</strong>s identified 20 us<strong>in</strong>g<br />

Ground 8, although only two did so as a matter of<br />

rout<strong>in</strong>e . An earlier national study of England found<br />

that about one third of <strong>association</strong>s used Ground<br />

8 but that <strong>the</strong>re were strik<strong>in</strong>g regional and landlord<br />

type variations . There was also evidence that District<br />

Judges disapproved of Ground 8 and <strong>in</strong> some cases<br />

sought to avoid grant<strong>in</strong>g possession <strong>in</strong> such <strong>in</strong>stances;<br />

for example by giv<strong>in</strong>g extra scrut<strong>in</strong>y to paperwork<br />

before <strong>the</strong> court . However, <strong>the</strong>se studies took place<br />

prior to Court of Appeal guidance on Ground 8 .<br />
