Although it might be contended that this should<br />

never happen, <strong>the</strong> vast majority of <strong>association</strong>s<br />

(84%) acknowledged that, <strong>in</strong> certa<strong>in</strong> circumstances,<br />

possession actions would be issued despite<br />

<strong>the</strong> existence of an outstand<strong>in</strong>g HB claim . Most<br />

respondents noted that this would be legitimate<br />

where it was believed that <strong>the</strong> tenant had failed<br />

to provide <strong>the</strong> HB section with <strong>in</strong>formation or<br />

proof required to substantiate <strong>the</strong> claim . O<strong>the</strong>r<br />

relevant circumstances mentioned by numerous<br />

respondents <strong>in</strong>cluded:<br />

• Where <strong>the</strong> tenant is receiv<strong>in</strong>g or judged eligible<br />

(by <strong>the</strong> <strong>association</strong>) for partial HB only but<br />

where contributions to <strong>the</strong> unfunded rent are<br />

not be<strong>in</strong>g made<br />

• Where <strong>the</strong> tenant is judged by <strong>the</strong> <strong>association</strong><br />

as <strong>in</strong>eligible for HB<br />

• Where <strong>the</strong> HB to which <strong>the</strong> tenant is believed<br />

entitled will not clear <strong>the</strong>ir debt (or where <strong>the</strong><br />

rema<strong>in</strong><strong>in</strong>g <strong>arrears</strong> would be above a given<br />

threshold amount)
