that <strong>the</strong> effects of specialisation could not be<br />

isolated as <strong>the</strong> change <strong>in</strong> structure often occurred<br />

at <strong>the</strong> same time as o<strong>the</strong>r changes to work<strong>in</strong>g<br />

practice, which could equally contribute to improved<br />

rent collection performance, <strong>in</strong>clud<strong>in</strong>g a greater<br />

emphasis on prevention . 70 Phelps and Carter found<br />

that <strong>practices</strong> <strong>in</strong> any case varied between hous<strong>in</strong>g<br />

officers with<strong>in</strong> <strong>the</strong> same <strong>association</strong>, cast<strong>in</strong>g fur<strong>the</strong>r<br />

doubt on <strong>the</strong> generalisation of <strong>the</strong> claims . 71 While<br />

<strong>the</strong> evidence here rema<strong>in</strong>s <strong>in</strong>conclusive, this is a<br />

relevant contextual consideration for <strong>the</strong> research;<br />

<strong>in</strong> particular, whe<strong>the</strong>r <strong>the</strong>re is a particular type of<br />

rent <strong>management</strong> arrangement, which correlates<br />

to more or less possession-focussed approaches .<br />

2.4 Use of <strong>the</strong> courts<br />

This section looks at what we know generally<br />

about <strong>the</strong> use and <strong>practices</strong> of <strong>the</strong> courts, before<br />

mov<strong>in</strong>g on more specifically to discuss <strong>the</strong> use<br />

of Ground 8 .<br />

Although <strong>the</strong>re are no official figures for <strong>the</strong><br />

number of Notices of Seek<strong>in</strong>g Possession<br />

(NSPs) which are not pursued, data collected<br />

from landlords <strong>in</strong> <strong>the</strong> Pawson et al study found<br />

that around 28% of notices entered by social<br />

landlords resulted <strong>in</strong> court action, with <strong>the</strong><br />

rema<strong>in</strong>der be<strong>in</strong>g resolved by hous<strong>in</strong>g officer<br />

activity between service of <strong>the</strong> NSP and <strong>the</strong> court<br />

date (some of which would also have expired) .<br />

Some HAs had a policy of requir<strong>in</strong>g a home visit<br />

after <strong>the</strong> service of <strong>the</strong> NSP – a practice seen as<br />

important <strong>in</strong> reduc<strong>in</strong>g <strong>the</strong> need for fur<strong>the</strong>r legal<br />

action . 72 Decisions to br<strong>in</strong>g proceed<strong>in</strong>gs to court<br />

often <strong>in</strong>volved higher-level staff <strong>in</strong> review<strong>in</strong>g <strong>the</strong><br />
