With<strong>in</strong> <strong>the</strong> transfer landlord cohort <strong>the</strong>re is also<br />

some regional contrast, with <strong>the</strong> <strong>in</strong>cidence of<br />

SLAs be<strong>in</strong>g considerably higher <strong>in</strong> <strong>the</strong> central<br />

and nor<strong>the</strong>rn regions (83%) than <strong>in</strong> London and<br />

<strong>the</strong> south (62%) . It is possible that this reflects a<br />

tradition of more effective HB adm<strong>in</strong>istration <strong>in</strong> <strong>the</strong><br />

latter regions – such that <strong>association</strong>s have not<br />

seen <strong>the</strong> necessity to establish SLAs .<br />

Whe<strong>the</strong>r or not prompted by <strong>the</strong> PAP, <strong>the</strong> vast<br />

majority of respond<strong>in</strong>g <strong>association</strong>s (88%) reported<br />

that staff were required to check a tenant’s HB<br />

status before issu<strong>in</strong>g a Notice Seek<strong>in</strong>g Possession .<br />

However, <strong>in</strong> prepar<strong>in</strong>g to issue a claim <strong>in</strong> court, only<br />

42% rout<strong>in</strong>ely sought an HB service certificate to<br />

confirm that no benefit enquiries were outstand<strong>in</strong>g .<br />

The 2004 ODPM 109 research identified HA<br />

frustration with what was seen as “<strong>in</strong>efficient” HB<br />

services . For some <strong>association</strong>s pressuris<strong>in</strong>g HB<br />

staff to prioritise resolution of a particular claim<br />

could <strong>in</strong>volve <strong>in</strong>itiat<strong>in</strong>g legal action aga<strong>in</strong>st <strong>the</strong><br />

tenant (<strong>in</strong> <strong>the</strong> belief that this would lead to speed<br />

up <strong>the</strong> process) . Here, <strong>the</strong>refore, <strong>in</strong> <strong>in</strong>stigat<strong>in</strong>g<br />

action aga<strong>in</strong>st a tenant, <strong>the</strong> <strong>association</strong>’s ma<strong>in</strong><br />

objective was to send a signal to <strong>the</strong> local authority .<br />

As shown <strong>in</strong> Table 5 .8, more than a quarter of<br />

<strong>association</strong>s <strong>in</strong>dicated that <strong>the</strong>y sometimes <strong>in</strong>itiated<br />

legal action <strong>in</strong> a bid to speed up <strong>the</strong> process<strong>in</strong>g<br />

of HB claims . However, this was much more<br />

common among traditional HAs than among<br />

transfer landlords (see Table 5 .8) . It was also much<br />

more common <strong>in</strong> London than elsewhere . Among<br />

<strong>association</strong>s regulated from London, 41% reported<br />

that issu<strong>in</strong>g NSPs <strong>in</strong> <strong>the</strong>se circumstances was an<br />

occasional practice .<br />
