• Where <strong>arrears</strong> were accrued before <strong>the</strong> HB<br />

claim was lodged and where <strong>the</strong> tenant is<br />

judged as hav<strong>in</strong>g no realistic expectation of<br />

a backdated payment (and previous <strong>arrears</strong><br />

are not be<strong>in</strong>g repaid)<br />

Ano<strong>the</strong>r relevant scenario mentioned by one<br />

respondent was where <strong>the</strong> action had been<br />

triggered for reasons o<strong>the</strong>r than rent <strong>arrears</strong> .<br />

More questionably, ano<strong>the</strong>r respondent stated<br />

simply that a claim might be pursued despite an<br />

outstand<strong>in</strong>g HB claim simply if <strong>the</strong>re were “very<br />

high <strong>arrears</strong>” . A sense of frustration was evident<br />

<strong>in</strong> <strong>the</strong> response stat<strong>in</strong>g that such action might be<br />

taken <strong>in</strong> “cases that drag on for months, where<br />

we have made every effort to assist benefits and<br />

claimants to resolve delay” .<br />

5.4 Arrears <strong>management</strong><br />

practice<br />

In addition to prob<strong>in</strong>g <strong>association</strong>s’ <strong>in</strong>teraction with<br />

HB services, <strong>the</strong> survey also <strong>in</strong>cluded questions<br />

about o<strong>the</strong>r aspects of <strong>arrears</strong> <strong>management</strong><br />

practice . In particular, <strong>the</strong>se sought to <strong>in</strong>vestigate<br />

<strong>the</strong> extent to which <strong>association</strong>s have been<br />

follow<strong>in</strong>g official good practice advice to<br />

prioritise personal contact with tenants <strong>in</strong><br />

<strong>arrears</strong> ra<strong>the</strong>r than rely<strong>in</strong>g ma<strong>in</strong>ly or exclusively<br />

on postal communication . 110<br />

As noted <strong>in</strong> <strong>the</strong> official guidance, an “early<br />

<strong>in</strong>tervention” strategy needs to encompass<br />

<strong>practices</strong> around <strong>the</strong> <strong>in</strong>itial tenancy sign-up<br />

process . Part of this is about mak<strong>in</strong>g clear <strong>the</strong><br />

grounds under which possession might be sought .<br />

Well over half of <strong>association</strong>s respond<strong>in</strong>g <strong>in</strong> <strong>the</strong><br />

survey (62%) reported that <strong>the</strong>ir tenancy sign-up<br />

procedures specifically required new tenants to<br />

be advised of <strong>the</strong>se .<br />

How quickly do <strong>association</strong>s react when <strong>arrears</strong><br />

beg<strong>in</strong> to accumulate? In four-fifths of <strong>association</strong>s<br />

participat<strong>in</strong>g <strong>in</strong> <strong>the</strong> survey, it was rout<strong>in</strong>e to <strong>in</strong>itiate<br />

some form of action <strong>in</strong> response to a s<strong>in</strong>gle<br />

missed payment . While this might be <strong>in</strong>terpreted<br />

as generally reassur<strong>in</strong>g, it also raises questions<br />

as to why such <strong>practices</strong> are not universal . It is<br />

also notable that respond<strong>in</strong>g to a s<strong>in</strong>gle missed<br />

payment appears to vary accord<strong>in</strong>g to <strong>association</strong><br />

size . Whereas <strong>the</strong> proportion of <strong>association</strong>s without<br />

such a procedure was only 17% among medium<br />

sized landlords (those manag<strong>in</strong>g 1,000-5,000<br />
