Section 8000 – Students 8005 Open Enrollment 8005 It shall be the continuing practice of the District to offer an open enrollment period annually to students as a means of providing voluntary integration of students within the District. Available space shall be determined by building Principals and central administration in terms of the capacity of the building to handle larger numbers of students. All decisions must comply with class size provisions of the master contract between the Board and the Saginaw Education Association. The preceding may be subject to review by the Board. It shall be the responsibility of the parents to furnish transportation to and from school. Information regarding school schedules will be made available by building Principals upon request to assist parents in coordinating transportation. A student who transfers under open enrollment must continue enrollment in that school for the balance of that year. No transfer will be made during a year unless approved by the Superintendent. A student who transfers to a school outside of his/her normal service area under this policy shall be deemed to be attending his/her local home school for purposes of interscholastic athletic competition and other interscholastic competition. Punctuality on the part of the parent in providing transportation to meet the school time schedule is important. Application forms for open enrollment will be furnished by the Board and must be in the office of student records by the conclusion of the open enrollment period set annually by the Board. Prior to the close of school, all applications will be reviewed and building assignments made by the administration. However, if the number of applicants exceeds the number that can be taken in a given school, the names will be placed in a box and a committee composed of at least two Board members and/or citizens will meet and draw names until all available space has been utilized. Section 8000 – Students 8015 Non-Discrimination and Complaint Procedure (Cf. 2450, 5030) 8015 It is the policy of the Board of Education that the District will not discriminate against any person based on sex, race, color, national origin, religion, height, weight, marital status, handicap, age, or disability. The District reaffirms its long-standing policy of compliance with all applicable federal and state laws and regulations prohibiting discrimination including, but not limited to, Titles VI and VII of the Civil Rights Act of 1964, 42 U.S.C. §§ 2000d. et seq.; and 42 U.S.C. §§ 2000e, et seq.; Title IX of the Educational Amendments of 1972, 20 U.S.C. §§ 1681, et seq.; Section 504 of the Rehabilitation Act of 1973, 29 U.S.C. § 794; The Americans With Disabilities Act of 1990, 42 U.S.C. §§ 1210, et seq.; the Persons with Disabilities Civil Rights Act, MCL §§ 37.1101, et seq.; and the Elliott-Larsen Civil Rights Act, MCL §§ 37.2101, et seq. The Civil Rights Coordinator, in conjunction with appropriate administrative staff, shall address complaints of disability/handicap discrimination involving educational services, programs, and activities. Discrimination complaints made by students and/or their parent(s)/guardian(s), and involving sex, race, color, national origin, religion, height, weight, age, or marital status shall be directed to the Civil Rights Coordinator. The administrator in charge of the Human Resources and Labor Relations Division is appointed the Civil Rights Coordinator regarding all other complains of discrimination except for any complaints that might be filed against the Superintendent of Schools. In the event the complaint is against the Superintendent of Schools, the Vice-President of the Board of Education is appointed the Civil Rights Coordinator. Any person who believes he/she has been discriminated against in violation of this policy should file a written complaint with the Civil Rights Coordinator within ten (10) calendar days of the alleged violation. The Civil Rights Coordinator will take, then, the following action: First, cause an investigation of the complaint to be commenced. Second, arrange for a meeting to occur with the complainant that may include School District staff who are knowledgeable of the facts and circumstances of the particular complaint or who have particular expertise that will assist in resolving the complaint. Third, complete the investigation of the complaint and provide, in writing, a reply to the complainant. If the Civil Rights Coordinator determines that a violation has occurred, he/she shall propose a fair resolution of the complaint and deliver the determination to the complainant and the School District’s Superintendent.
