10.<br />

Drawing together the factors of duty, mental state, and injury, Standards § 7.3<br />

suggests that a reprimand is generally appropriate when a lawyer negligently engages<br />

in conduct that is a violation of a duty owed to the profession, and causes potential<br />

injury to a client, the public, or the legal system.<br />

<strong>Oregon</strong> case law is in accord. See In re Dixon, 17 DB Rptr 75 (2003); In re<br />

Bassett, 16 DB Rptr 190 (2002).<br />

11.<br />

Consistent with the Standards and <strong>Oregon</strong> case law, and considering the<br />

mitigating factors properly attributable to the Accused, the parties agree that the<br />

Accused shall be publicly reprimanded for violation of DR 3-101(B).<br />

12.<br />

This Stipulation for Discipline is subject to review by Disciplinary Counsel of<br />

the <strong>Oregon</strong> <strong>State</strong> <strong>Bar</strong>. The sanction provided for herein has been approved by the<br />

<strong>State</strong> Professional Responsibility <strong>Board</strong> (“SPRB”). If approved by Disciplinary<br />

Counsel, the parties agree the stipulation is to be submitted to the Disciplinary <strong>Board</strong><br />

for consideration under the terms of BR 3.6.<br />
