C. Injury. Podesfinski incurred actual injury in that he was denied the<br />

timely resolution of his legal matter and was frustrated by the Accused’s inattention<br />

to the matter and lack of communication.<br />

D. Aggravating Factors. Aggravating factors include:<br />

The Accused has substantial experience in the practice of law. Standards,<br />

§ 9.22(i).<br />

E. Mitigating Factors. Mitigating factors include:<br />

1. The Accused has no prior disciplinary record. Standards, § 9.32(a).<br />

2. The Accused did not act with a dishonest or selfish motive. Standards,<br />

§ 9.32(b).<br />

3. The Accused acknowledged and fully disclosed his conduct to the<br />

Disciplinary Counsel’s Office in the investigation and is remorseful. Standards,<br />

§ 9.32(e), (m).<br />

The Standards provide that reprimand is generally appropriate when a lawyer<br />

is negligent and does not act with reasonable diligence in representing a client and<br />

causes injury or potential injury to a client. Standards, § 4.43.<br />

<strong>Oregon</strong> case law is in accord. See In re Cohen, 330 Or 489, 8 P3d 953 (2000)<br />

(lawyer reprimanded for violating DR 6-101(B)); In re Mullen, 17 DB Rptr 22 (2003)<br />

(lawyer reprimand for violating DR 6-101(B)).<br />

13.<br />

Consistent with the Standards and <strong>Oregon</strong> case law, the parties agree that the<br />

Accused shall be reprimanded for violation of DR 6-101(B).<br />

14.<br />

This Stipulation for Discipline is subject to review by Disciplinary Counsel of<br />

the <strong>Oregon</strong> <strong>State</strong> <strong>Bar</strong> and to approval by the <strong>State</strong> Professional Responsibility <strong>Board</strong><br />

(“SPRB”). If approved by the SPRB, the parties agree the stipulation is to be<br />

submitted to the Disciplinary <strong>Board</strong> for consideration under the terms of BR 3.6.<br />
