AMENDED ORDER ALLOWING MOTION TO<br />

VACATE APPELLATE JUDGMENT<br />

Upon consideration by the court.<br />

The court allows the <strong>Oregon</strong> <strong>State</strong> <strong>Bar</strong>’s motion to vacate the appellate<br />

judgment of April 8, 2002. The suspension will automatically be vacated and Elissa<br />

M. Ryan will be reinstated as an active member of the <strong>Bar</strong> once she pays the <strong>Bar</strong><br />

dues and PLF assessment. Ryan’s administrative suspension of April 11, 1997, is<br />

declared void. The <strong>Bar</strong> shall refund to Ryan $2,749.65 in costs. All additional relief<br />

requested by Elissa M. Ryan is denied. The case is dismissed.<br />

MOTION TO VACATE APPELLATE JUDGMENT<br />

AND SUSPENSION AND TO DISMISS<br />

The <strong>Oregon</strong> <strong>State</strong> <strong>Bar</strong> moves the Supreme Court to vacate the appellate<br />

judgment entered in this proceeding and the suspension imposed upon the Accused<br />

effective April 8, 2002, and to dismiss the proceeding in its entirety. This motion is<br />

based on the following points and authorities:<br />

POINTS AND AUTHORITIES<br />

1. On February 5, 2002, the court issued its order in In re Ryan,<br />

SC S48903, accepting the parties’ stipulation upon review and suspending the<br />

Accused from the practice of law for 18 months. A copy of the court’s order is<br />

attached to this motion as Exhibit A. A copy of the stipulation upon review with the<br />

trial panel opinion in this matter is attached to this motion as Exhibit B. The<br />

Appellate Judgment was effective April 8, 2002.<br />
