OPINION OF THE TRIAL PANEL
In this matter, the Accused failed to answer or appear. Accordingly, the Trial
Panel entered an Order, dated October 25, 2004, finding the Accused in default under
BR 5.8. The Trial Panel is, therefore, taking the allegations in the Bar’s Formal
Complaint as true.
The Trial Panel exercised its discretion to request and consider evidence and
legal authority submitted by the Bar limited to the issue of sanctions. BR 5.8. The
Panel has reviewed the Bar’s submission and hereby adopts as its findings and
conclusions the facts and recommendations set forth in the Bar’s sanctions
memorandum submitted on December 22, 2004. That memorandum is attached hereto
and incorporated herein by this reference.
