STIPULATION UPON REVIEW<br />

Pursuant to BR 10.4(b), the <strong>Oregon</strong> <strong>State</strong> <strong>Bar</strong>, by and through Assistant<br />

Disciplinary Counsel Martha M. Hicks, and the Accused, Elissa M. Ryan, by and<br />

through her attorney, Susan D. Isaacs, stipulate that they find the trial panel opinion<br />

acceptable and the discipline imposed appropriate. A copy of the trial panel opinion<br />

in the above-captioned matter is attached hereto and by reference incorporated herein.<br />

The parties further petition the court to review this matter without briefs and<br />

argument.<br />

OPINION OF THE TRIAL PANEL<br />

Introduction<br />

By its Formal Complaint of May 13, 1999, the <strong>Oregon</strong> <strong>State</strong> <strong>Bar</strong> (“<strong>Bar</strong>”)<br />

alleges that Ellisa M. Ryan (“Accused”) violated the following standards of<br />

professional conduct established by law and by the <strong>Bar</strong>:<br />

DR 1-102(A)(3), which prohibits a lawyer from engaging in conduct<br />

involving dishonesty, fraud, deceit, or misrepresentation;<br />

DR 3-101(B), which prohibits a lawyer from practicing law where to<br />

do so is in violation of <strong>Bar</strong> regulations;<br />

DR 7-102(A)(5), which prohibits a lawyer from knowingly making a<br />

false statement of law or fact in the course of the lawyer’s representation of<br />

a client;<br />

ORS 9.160, which prohibits a person from the practice of law unless the<br />

person is an active member of the <strong>Bar</strong>; and<br />
