The ASAA Executive Committee shall issue a written decision with<strong>in</strong> ten (10) clear days of the<br />

conclusion of the hear<strong>in</strong>g. The decision of the ASAA Executive Committee shall be f<strong>in</strong>al and b<strong>in</strong>d<strong>in</strong>g<br />

and shall not be subject to judicial review.<br />

ATHLETIC RECRUITMENT AND UNDUE INFLUENCE<br />

To ma<strong>in</strong>ta<strong>in</strong> the proper relationship between the academic purposes of schools and their athletic<br />

activities, all member schools of the ASAA and anyone directly connected to the school (<strong>in</strong>clud<strong>in</strong>g<br />

alumni associations, booster clubs and parent groups) must refra<strong>in</strong> from recruitment, <strong>in</strong>ducement or<br />

other <strong>for</strong>ms of undue <strong>in</strong>fluence that would encourage a student to enroll <strong>in</strong> or transfer to a school<br />

primarily <strong>for</strong> athletic purposes after the student has entered grade 10.<br />

A. The possible existence of undue <strong>in</strong>fluence or recruitment shall be decided on a case by case basis.<br />

B. Undue <strong>in</strong>fluence or recruitment may <strong>in</strong>clude:<br />

1. any offer of monetary or transportation assistance to a student, parent or guardian (<strong>in</strong>clud<strong>in</strong>g<br />

fees, tuition, bus passes or other allowances or waivers). Provided however, that <strong>for</strong> the<br />

purposes of these Bylaws, waiver of any fee ord<strong>in</strong>arily charged to an <strong>in</strong>ternational student by<br />

a school, school board, or school division, shall not necessarily be considered undue<br />

<strong>in</strong>fluence or recruitment. Provided further that, when determ<strong>in</strong><strong>in</strong>g whether undue <strong>in</strong>fluence or<br />

recruitment exists, the ASAA Executive shall be entitled to consider whether such fees are<br />

waived <strong>for</strong> students not <strong>in</strong>volved <strong>in</strong> athletic activities;<br />

2. the offer or acceptance of school privileges or considerations not normally granted to other<br />

students;<br />

3. any <strong>in</strong>ducement or attempted <strong>in</strong>ducement of parents, guardians or students to change their<br />

location of residence <strong>for</strong> athletic reasons;<br />

4. the contact<strong>in</strong>g of a student or parent or guardian of a student who attends another school <strong>in</strong> an<br />

attempt to persuade that student, primarily <strong>for</strong> athletic purposes, to attend the <strong>in</strong>ducer’s<br />

school;<br />

5. the attempt to persuade or <strong>in</strong>duce a student, primarily <strong>for</strong> athletic purposes, to rema<strong>in</strong> <strong>in</strong> the<br />

<strong>in</strong>ducer’s school, when the student had otherwise decided to transfer to another school.<br />

C. If a person has knowledge of undue <strong>in</strong>fluence or recruitment, as def<strong>in</strong>ed here<strong>in</strong> and allegedly<br />

committed by any other student, coach, teacher, school staff, or adm<strong>in</strong>istrative personnel connected<br />

with an ASAA member school, he/she shall provide written notice of the allegation of undue<br />

<strong>in</strong>fluence or recruitment to the pr<strong>in</strong>cipal of the school <strong>in</strong>volved, the secretary of the Executive of the<br />

ASAA zone <strong>in</strong> which the school is located and the Executive Director of the ASAA.<br />

D. With<strong>in</strong> three clear days (see SECTION VI - APPEAL PROCEDURE, Def<strong>in</strong>ition of Clear Days, page<br />

64) of receipt of the written notice referred to <strong>in</strong> paragraph C here<strong>in</strong>, the Executive of the ASAA<br />

Zone with<strong>in</strong> which the undue <strong>in</strong>fluence and/or recruitment is alleged to have occurred shall<br />

commence an <strong>in</strong>vestigation of the allegations conta<strong>in</strong>ed <strong>in</strong> the written notice. Investigations of<br />

allegations of athletic recruitment and undue <strong>in</strong>fluence shall be conducted as follows:<br />

1. The allegations of athletic recruitment and undue <strong>in</strong>fluence shall be fully disclosed by the<br />

<strong>in</strong>vestigat<strong>in</strong>g zone executive to the party aga<strong>in</strong>st whom they are made and to any member<br />

school which that party attends, or to any member school at which that party is employed, or<br />

at any member school to which that party is otherwise associated (also see ATA Code of<br />

Professional Conduct, page 154).<br />
