The Fourth Resolutionon Artificial Inseminationand Test-Tube BabiesAll Praise be to Almighty Allah.Blessing and peace be on His Prophet Muhammadafter whom there is no prophet, and on all thosewho followed his way of guidance.The Islamic Fiqh Council during its 5 th session held between 8-16 Rabi Al-Aakhir 1402H (2-10 February 1982) looked into theissue of artificial insemination and test-tube babies and reviewedthe detailed research prepared and presented by some of theCouncil members on this issue in the previous session. It alsoreviewed the information collected by other members from thenew writings on this issue. In the light of the informationcollected on this issue, the Council studied the issue from allaspects and dimensions.After the thorough discussion, it reached the conclusion thatthis issue is very sensitive from the religious point of view and ithas many dimensions. It has also serious consequences andrepercussions on the life of family and its moral and socialconditions, which are already seen in the foreign countries.This issue has also certain aspects – in the religious perspective–related to the issues of legitimacy and illegitimacy, rules of needand emergency, regulations of lineage and doubtfulness, themarital bed, pregnant woman’s sexual relationship with personother than the husband, rules of Iddat, purity of womb, sanctityof marriage, the rules of punishment in Islam through Hadd orTa’zeer as there involved aspects which are not permissible in thereligion such as the forms of internal insemination in woman andexternal insemination in the test-tube, then its plantation in womb129
