The Third Resolutionon Obligatory Establishment of Mosquein Every LocalityAll praise be to Almighty Allah.Blessing and peace be on His Prophet Muhammadafter whom there is no prophet, and on all thosewho followed his way of guidance.The Islamic Fiqh Council in its 9 th session held in MakkahMukarramah during 12-19 Rajab 1406H looked into the matterreferred by the World Supreme Council of Mosques about theobligatory establishment of mosque in every locality whereMuslims live.The Council reviewed reports and opinions presented bysome of its members in this regard in the light of viewssubscribed by the various schools of Islamic Fiqh about thejurisprudence status of Salat Al-Jama’ah (congregational prayer)in mosques, because it is a ritual of Islam which must behighlighted in Muslim societies, other than the prayer ofJumu’ah, which according to the unanimous view of Muslimscholars, is obligatory for every Muslim. An individual Muslimis exempted from it only due to the excuses which are acceptablein the Islamic Shari'ah.After discussion among its members, the Council was of theview that the congregational prayer in towns and villages in thevarious seasons of the year cannot be performed without theestablishment of mosques where worshippers can gather at fivetimes a day, because a suitable place is essential for any activity,and it is an established principle in the Islamic Fiqh that anything239
